Order Entered: 1. LG&E/KU’s motion to be relieved of filing annual updates of a legal merger study is granted in part and denied in part. 2. LG&E/KU’s request to be relieved of filing in this proceeding legal merger studies on an annual basis is granted. 3. LG&E/KU’s request to be relieved of filing a legal merger study update is denied. 4. LG&E/KU shall file a legal merger study update with each application LG&E/KU files for a general rate adjustment pursuant to KRS 278.190 and 807 KAR 5:001, Section 16, until further Order of the Commission. 5. Legal merger study updates filed in the future shall reflect an unbiased review of the benefits and costs of a legal merger and address those qualitative risks that continually identified by LG&E/KU as a hurdle to legal merger. |

KU’s request for a deferral of the company’s submission of its next RTO Membership Analysis and to submit such analysis in its 2021 IRP is granted to the extent that KU shall file the analysis annually by March 31st in the post-case correspondence file of its most recent, or current, rate case. However, in the year in which KU is required to file an IRP, KU shall file the analysis in conjunction with its IRP. 2. KU shall also file its most recent RTO Membership Analysis with each future rate case until directed otherwise. 3. All other provisions of the Final Order remains in full force and effect. |

Order Entered: 1. KU's motion for confidential treatment made on September 28, 2018, is hereby denied in part and granted in part. 2. KU failed to establish that the information produced as part of Tab 60 for which confidential treatment was sought meets the criteria for confidential treatment, and therefore that information shall be made available to the public. 3. The customer-identifying information produced, pursuant to 807 KAR 5:001, Section 16(7)(c), as part of the application for which confidential treatment was sought, meets the criteria for confidential treatment, and therefore that information shall be exempt from public disclosure indefinitely. 4. Final Order Entered: 1. The rates and charges proposed by KU are denied. 2. KU's motions for leave to file the PSA Stipulation and the testimonies in support of the PSA Stipulation and the Rate Case Stipulation are granted. 3. The PSA and Rate Case Stipulations, along with the Addendum, attached hereto as Appendix A, (without exhibits) are approved with the modification discussed herein. 4. The rates and charges in Appendix B, attached hereto, are fair, just, and reasonable for KU to charge for service rendered on and after May 1, 2019. 5. Within 20 days of the date of this Order, KU shall file with the Commission, using the Commission's electronic Tariff Filing System, its revised tariffs as set forth in this Order reflecting that they were approved pursuant to this Order. 6. If KU submits a LOLP COSS as part of its next base rate application, KU shall also provide an alternative COSS along with the LOLP COSS. 7. As part of its annual report, KU shall file updates to its RTO membership study and potential legal merger study. 8. KU shall, within 14 days of date of the creation of the regulatory liability associated with KU's request at FERC to remove the MMD component in transmission Rate Schedule No. 402, provide to the Commission, the accounting entries made on its books to effectuate the creation of the regulatory liability. 9. Any document filed pursuant to ordering paragraph 8 of Order shall reference number of case and shall be retained in post-case correspondence file. |
