Kentucky Public Service Commission

Order Entered: 1. South Kentucky RECC's Fourth Motion for Confidential Treatment is denied. 2. South Kentucky RECC's Fifth Motion for Confidential Treatment is granted. 3. The designated material in South Kentucky RECC's Fifth Motion for Confidential Treatment for which confidential treatment has been granted shall remain confidential for a period of ten years from the date of entry of this order, or until further Order of the Commission. 4. The designated material in South Kentucky RECC's Fourth Motion for Confidential Treatment for which confidential treatment has been denied shall not be placed in the public record or made available for inspection for 20 days from the date of entry of this Order to allow South Kentucky RECC to seek a remedy afforded by law. 5. Within 20 days of the date of entry of this Order, South Kentucky RECC shall file revised documents identified in the Fourth Motion for Confidential Treatment reflected as unredacted the information that has been denied confidential treatment. 6. Use of the material that was granted confidential treatment in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 7. South Kentucky RECC shall inform the Commission if the material granted confidential treatment become publicly available or no longer qualify for confidential treatment.

Order Entered: 1. EKPC's May 8, 2018 Motion for Confidential Treatment is granted. 2. EKPC's May 24, 2018 Motion for Confidential Treatment is granted. 3. The materials for which EKPC's requests for confidential treatment has been granted shall remain confidential for a period of ten years from the date of entry of this order, or until further order of the Commission. 4. Use of the materials that were granted confidential treatment in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 5. EKPC shall inform the Commission if the materials granted confidential treatment become publicly available or no longer qualify for confidential treatment. 6. If a non-party to this proceeding requests to inspect materials granted confidential treatment by this order and the period during which the material have been granted confidential treatment has not run, EKPC shall have 20 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If EKPC is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 7. The Commission shall not make the materials available for inspection for 20 days following an order finding that the materials no longer qualify for confidential treatment in order to allow EKPC to seek a remedy afforded by law.

Order Entered, nunc pro tunc, that: 1. The sentence on page 38 that reads "Further, the Commission's finding that the PPA should be denied because it violates KRS Chapter 278 stands separate and apart from the Commission finding that the alternate source provisions in Amendment 3 and the MOU should be stricken from EKPC's because they violate KRS Chapter 278" is stricken and is replaced with the following sentence: Further, the Commission's finding that the PPA should be denied because it violates KRS Chapter 278 stands separate and apart from the Commission finding that the alternate source provisions in Amendment 3 and the MOU should be stricken from EKPC's tariff because they violate KRS Chapter 278. 2. All provisions of the September 27, 2018 Order that are not in conflict with the terms of this Order shall remain in effect.

Final Order Entered: 1. South Kentucky RECC's application requesting approval of the PPA is denied. 2. The alternate source election provisions of Amendment 3 violate KRS Chapter 278 and the alternate source election provisions are terminated and stricken from EKPC's tariff effective as of the date of the entry of this Order. The remaining provisions of Amendment 3 not in conflict with this Order continue in effect pursuant to the terms of Amendment 3. 3. The MOU violates KRS Chapter 278 and is terminated and stricken from EKPC's tariff effective as of the date of the entry of this Order. 4. Salt River Electric's motion to strike is denied. 5. EKPC's motion to strike is denied. 6. This case is closed and removed from the Commission's docket.

Paragraph 6 of the February 19, 2018 Order is corrected to state: "Any motion to intervene filed after February 23, 2018, shall show a basis for intervention and good cause for being untimely, and must state with specificity the person's special interest that is not otherwise adequately represented, or the issues and facts the person will present that will assist the Commission in fully considering the matter. If the untimely motion is granted, the movant shall accept and abide by the existing procedural schedule." 2. All other provisions of the February 19, 2018 Order shall remain in full force and effect.

South Kentucky's request to deviate from the filing requirements in 807 KAR 5:001 , Section 18(1 )(c)-(g) and (2)(c) is granted, and the Application is deemed filed as of the date of this Order. 2. South Kentucky's Application for approval of the Agreement with Morgan Stanley Capital is continued beyond the 60-day period specified in KRS 278.300(2). 3. The procedural schedule set forth in the Appendix to this Order shall be followed. 4. Any document filed with the Commission shall be served on all parties of record, with the original and ten copies in paper medium to the Commission. 5. a.
