Final Order Entered: 1. The recommendations contained in the Commission Staff’s Report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The water service rates proposed by Peaks Mill District are denied. 3. The water service rates set forth in Appendix B to this Order are approved for service rendered by Peaks Mill District on or after the date of service of this Order. 4. Within 20 days of the date of service of this Order, Peaks Mill District shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order. 5. The Commission shall open a separate proceeding, Case No. 2024-00256, to monitor the surcharge proceeds collection and expenses subject to the following conditions: a. Within 120 days of the date of service of this Order, Peaks Mill District shall file into the record of Case No. 2024-00256 a QIIP, including a comprehensive unaccounted-for water loss reduction plan that establishes priorities and a time schedule for eliminating each source of unaccounted-for water loss and provides a detailed spending plan for the proceeds of a surcharge. b. Peaks Mill District shall deposit and maintain surcharge collections in a separate interest-bearing account.

Order Entered: 1. Peaks Mill District’s amended application is accepted as filed as of June 11, 2024. 2. Peaks Mill District shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of service of this Order, Peaks Mill District shall notify its customers of the implementation of the rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Peaks Mill District shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for a decision based upon the existing record.

Order Entered: 1. The procedural schedule set forth in Appendix A to this Order shall be followed. 2. On or before the date set forth in the procedural schedule, Peaks Mill District shall file its responses to the Commission Staff’s request for information, attached to this Order as Appendix B. 3. Peaks Mill District shall respond to any additional requests for information propounded by Commission Staff as provided in those requests. 4. No later than the date set forth in the procedural schedule, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Commission Staff’s Report) containing its recommendations regarding Peaks Mill District’s requested rate adjustment. 5. No later than 14 days after the date of service of the Commission Staff’s Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings contained in the Commission Staff’s Report; and b. Any additional evidence for the Commission to consider. 6. If Commission Staff recommends that Peaks Mill District’s financial condition supports a higher rate than Peaks Mill District proposes or the assessment of an additional rate or charge not proposed in Peaks Mill District’s application, Peaks Mill District in its response to the Commission Staff’s Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the additional rate or charge.
