Order Entered nunc pro tunc, that: 1. The following is added to the May 16, 2023 Order as ordering paragraph 5: Within 20 days of the date of service of this Order, Harrodsburg shall file with the Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved by this Order and their effective date, and also stating that the rates and charges were authorized by this Order. 2. All other provisions of the Commission’s May 16, 2023 Order that are not in conflict with the provisions of this Order shall remain in effect.

Final Order Entered: 1. The wholesale rate proposed by Harrodsburg is granted. 2. Harrodsburg shall recover $14,181 for rate case expenses related to legal fees through a monthly rate case expense surcharge over a period of 36-months of $196.96 per wholesale customer per month. 3. The rates set forth in the Appendix to this Order are fair, just and reasonable and should be approved for the provision of wholesale water service to Lake Village Water and North Mercer District for services rendered on and after service of this Order. 4. This case is closed and removed from the Commission’s docket.

Harrodsburg’s motion to accept the filing of its proposed tariff related to a rate case expense surcharge and incorporate the issue of its reasonableness of that surcharge into the record of this case is granted. 2. Harrodsburg’s motion for a deviation from 807 KAR 5:011, Section 2, filing requirements is granted. 3. The proposed rates set forth in Harrodsburg’s proposed tariff sheet filed on December 21, 2022, are suspended for five months, from December 21, 2022, up to and including May 21, 2023. 4. The proposed rates set forth in Harrodsburg’s tariff sheet filed on December 21, 2022, supersede the originally proposed rates set forth in Harrodsburg’s tariff sheet filed on September 27, 2022. 5. The amended procedural schedule set forth in the Appendix to this Order shall be followed. 6. All provisions of the October 25, 2022 Order that are not in conflict with the terms of this Order shall remain in effect. 7. Nothing contained herein shall prevent the Commission from entering further Orders in this matter.
