Final Order Entered: 1. This case is opened to address certain outstanding petitions for confidential treatment. 2. The petitions for confidential treatment listed in Appendix B to this Order are granted. 3. The granting of these petitions shall not be cited as precedent in other proceedings before the Commission. 4. All movants shall review the petitions to determine if the material for which confidential treatment was requested still warrants confidential treatment. 5. A movant shall inform the Commission in writing, and filed in the original case file, if it determines that the information contained in a petition that is granted by this Order no longer warrants confidential treatment. 6. The Commission shall make available for inspection, upon request, any materials that a movant determines no longer warrants confidential treatment. 7. This case is closed and removed from the Commission's docket.

Order Entered: 1. Kentucky-American's January 29, 2016 and June 29, 2016 petitions for confidential protection are granted. 2. Kentucky-American's April 15, 2016 petition is granted in part and denied in part. The designated materials in the April 15, 2016 petition, with the exception of executive office compensation information, is granted confidential protection. The executive office compensation information in the April 15, 2016 petition is denied confidential protection. 3. The designated materials for which confidential protection was granted shall not be placed in the public record or made available for public inspection for an indefinite time, or until further Orders of this Commission. 4. Within 30 days of the date of this Order, Kentucky-American shall file a revised response to Staff's Second Request, item 33(c)-(d), reflecting as unredacted the material for which confidential protection was denied in ordering paragraph 2. 5. KAWC's request for confidential protection for its responses to Staffs Second Request, Items 29.a.-29.d., AG's First Request, Items 9.a.-9.d., 52, and 64.c., is granted in part, as discussed in the findings above. Order Entered: KAWC's motion for confidential protection is granted in part and denied in part. 2. Pursuant to KRS 61.878, excepting executive officer compensation information, the information for which KAWC requests confidential protection shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Order of the Commission. 3. The executive officer compensation information for which KAWC requests confidential protection does not fall within the scope of KRS 61.878 and therefore is denied confidential protection. 4. Order Entered: 1. KAWC's June 24, 2016 Petition for confidential protection is granted. 2. The material supplied in response to the AG's Initial Request, Item 22, and submitted as an attachment to KAWC's Petition shall not be placed in the public record or made available for public inspection for an indefinite time, or until further Orders of this Commission. 3. Use of the materials in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. KAWC shall inform the Commission if the materials in question become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect materials granted confidential treatment by this Order, K.AWC shall have 20 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61 .878. If K.AWC is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the requested materials available for inspection for 20 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow K.AWC to seek a remedy afforded by law.

Final Order Entered: 1. The rates and charges proposed by Kentucky-American are denied. 2. Kentucky-American's motion to approve the unanimous Settlement Agreement, attached hereto as Appendix A, is granted. 3. The rates and charges set forth in the Appendix B to this Order are fair, just, and reasonable and are approved for water service that Kentucky-American renders on and after August 28, 2016. 4. The depreciation rates set forth in Exhibit B of the Settlement Agreement are approved and authorized for Kentucky-American's use effective August 28, 2016. 5. Kentucky-American and AWWC are released from Condition 16 in Appendix A of the Commission's April16, 2007 Final Order in Case No. 2006-00197. 6. Kentucky-American shall, within 120 days of the date of this Order, file a report that describes the billing practices that it has in place to ensure that a Kentucky-American customer is able to determine whether the amounts on his or her bill have been correctly calculated. 7. Kentucky-American shall desist from the "long bill" and "short bill" practice that is not contained in its tariff sheets on file with the Commission. 8. Kentucky-American shall, within 90 days of the date of this Order, refund with interest all amounts collected since January 1, 2012, due to a "long bill" monthly service charge that has not already been offset by a "short bill."

A hearing for the purpose of taking evidence and argument on KAWC's application shall be held on July 12, 2016, beginning at 9:00 a.m., Eastern Daylight Time, at the offices of the Public Service Commission, 211 Sower Boulevard, Frankfort, Kentucky. 4. KAWC shall publish notice of the scheduled hearing in accordance with 807 KAR 5:001, Section 9(2)(b), no more than 21 days and no less than seven days before the day of the scheduled hearing in all areas in which it provides water service. In addition, the notice of hearing shall include the following statement: "This hearing will be streamed live and may be viewed on the PSG website, psc.ky.gov." 5. Pursuant to KRS 278.360 and 807 KAR 5:001, Section 9(9)(a), the record of the hearing in this matter shall be by digital video recording. 6. Order Entered: 1. KAWC's proposed rates are suspended for six months, up to and including August 27, 2016. 2. The procedural schedule set forth in the Appendix to this Order shall be followed. 3. a. Responses to requests for information in paper medium shall be appropriately bound, tabbed and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided, with an original and an electronic version to the Commission. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or an association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person's knowledge, information, and belief formed after a reasonable inquiry. c. A party shall make timely amendment to any prior response if it obtains information which indicates that the response was incorrect when made or, though correct when made, is now incorrect in any material respect. d. For any request to which a party fails to furnish all or part of the requested information, the party shall provide a written explanation of the specific grounds for its failure to completely and precisely respond.
