Order Entered: 1. The procedural schedule set forth in the Appendix to this Order shall be followed. 2. Navitas KY shall respond to all requests for information propounded by Commission Staff (Staff), whether identified on the procedural schedule or otherwise, as provided in those requests. 3. No later than the date set forth in the procedural schedule, Staff shall file with the Commission and serve upon all parties of record a written report (Staff Report) containing its recommendations regarding Navitas KY’s requested rate adjustment. 4. No later than 14 days after the date of service of the Staff Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings and recommendations contained in the Staff Report; and b. Any additional evidence for the Commission to consider. 5. If Staff finds that Navitas KY’s financial condition supports a higher rate than Navitas KY proposes or the assessment of an additional rate or charge not proposed in Navitas KY’s application, Navitas KY in its response to the Staff Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the additional rate or charge. |

Navitas KY is authorized to place into effect the interim base rate increase, subject to refund, set forth in the Appendix B to this Order, for service rendered on and after the date of this Order. 2. Navitas KY shall maintain its records in such a manner as will enable it, or the Commission, or any of Navitas KY’s customers, to determine the amounts to be refunded and to whom any refund is due in the event that a refund of any portion of the interim base rate increase is ordered by the Commission. 3. Nothing in this Order shall be construed as preventing further Orders of the Commission. |

Order Entered: 1. Navitas KY’s request for a deviation of 807 KAR 5:076, Section 5(2)(b)(2) is granted. 2. Navitas KY’s application is deemed filed as of the date of the issuance of this Order. 3. Navitas KY’s request for a hearing for rate relief is granted. 4. Navitas KY shall mail both the corrected customer notice as well as the hearing notice within seven days of issuance of this Order. 5. Pursuant to 807 KAR 5:001, Section 2, if the hearing is not concluded on the designated day, the hearing may be continued upon verbal announcement by the presiding officer. A verbal announcement made by the presiding officer shall be proper notice of the continued hearing. |
