Final Order Entered: 1. The recommendations contained in the Commission Staff’s Report, are adopted and incorporated by reference into this Order as if fully set out herein. 2. The water service rates proposed by Morgan District are denied. 3. The water service rates set forth in Appendix B to this Order are approved for service rendered by Morgan District starting the next full billing cycle after the date of this Order. 4. Within 20 days of the date of service of this Order, Morgan District shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order. 5. The record of this proceeding shall be incorporated by reference into the record of Case No. 2024-00325.¹²7 6. A copy of this Order shall be place in the case file of Case No. 2024-00325. 7. This case is closed and removed from the Commission’s docket.

Order Entered: 1. Morgan District’s motion for deviation is granted. 2. Morgan District is authorized to place into effect the interim base rate increase, subject to refund, on and after August 16, 2024, or starting with the next full billing cycle. 3. Morgan District shall file corrected, updated tariffs consistent with the rates from the Commission’s July 26, 2024 Order. 4. Morgan District shall maintain its records in such a manner as will enable it, or the Commission, or any of Morgan District’s customers, to determine the amounts to be refunded and to whom any refund is due in the event that a refund of any portion of the interim base rate increase is ordered by the Commission. 5. Should Morgan District fail to comply with the terms and conditions of this Order, any and all amounts collected as a result of the interim base rate increase granted hereunder shall be subject to refund, and both Morgan District and its Board shall be subject to all applicable penalties under KRS 2780.99. 6. All other provisions of the Commission’s July 26, 2024 Order, not in conflict with this order, shall remain if full force and effect.

Order Entered: 1. Morgan District’s April 26, 2024 motion for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for ten years or until further order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. If the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment, Morgan District shall inform the Commission and file with the Commission an unredacted copy of the designated material. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Morgan District shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Morgan District is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Order Entered: 1. Morgan District’s motion for an emergency hearing is granted. 2. Morgan District’s motion for a deviation from notice requirements set forth in 807 KAR 5:076 Section (3) is denied. 3. A hearing in this matter shall be held on May 2, 2024, at 9 a.m. Eastern Daylight Time and will continue until called from the bench by the presiding officer, in the Richard Raff Hearing Room at the offices of the Public Service Commission at 211 Sower Boulevard, Frankfort, Kentucky. 4. Pursuant to 807 KAR 5:001, Section 2, if the hearing is not concluded on the designated day, the hearing may be continued upon verbal announcement by the presiding officer. A verbal announcement made by the presiding officer shall be proper notice of the continued hearing. 5. Morgan District, including its Manager, Chairman and Treasurer of its Board of Commissioners shall participate in person at the May 2, 2024 hearing. 6. Morgan District shall file a witness list at least seven days prior to May 2, 2024. 7. Morgan District shall give notice of the hearing in compliance with 807 KAR 5:076, Section 12. In addition, the notice of hearing shall include the following statements: “This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov” and “Public comments may be made at the beginning of the hearing. Those wishing to make oral public comments may do so by following the instructions listed on the PSC website, psc.ky.gov.”
