Order Entered nunc pro tunc, that: 1. The following language is amended in the Commission's Order entered June 2, 2020. On May 19, 2020, East Kentucky Power Cooperative, Inc. (EKPC) on behalf of its member cooperatives Inter-County Energy Cooperative Corp. (Inter-County), Nolin RECC (Nolin), and Shelby Energy Cooperative (Shelby), filed a petition for rehearing pursuant to KRS 278.400, stating that the May 6, 2020 Order failed to address the requests of Inter- County, Nolin, and Shelby to revise their pass-through mechanisms to pass-through environmental surcharge amounts billed by EKPC for Rate B, C, G, and special contract customers directly on to those customers before the surcharge pass-through factor is determined. 2. All other provisions of the Commission's June 2, 2020 Order not in conflict with this Order shall remain in full force and effect. 3. This case is closed and removed from the Commission's docket. |

Order Entered: 1. EKPC's petition for rehearing is granted. 2. Inter-County, Nolin, and Shelby's request to revise their pass-through mechanisms, reporting formats, and tariffs, as described above, is granted. 3. Within 20 days from the date of entry of this Order, Inter-County, Nolin, and Shelby shall file with this Commission, using the Commission's electronic Tariff Filing System, revised tariff sheets as approved in this Order and reflect that they were approved pursuant to this Order. 4. All other provisions of the Commission's May 6, 2020 Order not in conflict with this Order shall remain in full force and effect. 5. This case is closed and removed from the Commission's docket. |

Final Order Entered: 1. EKPC's request to submit the case for a decision on the existing evidence 2. The amounts billed by EKPC through its environmental surcharge for the expense period June 1, 2017, to May 31, 2019, are approved. 3. EKPC shall use a rate of return of 5.975 percent in all monthly environmental surcharge filings subsequent to the date of this Order. 4. EKPC's Member Cooperatives shall include the applicable monthly retail pass-through adjustments, shown in the Appendix to this Order, in the determination of each Member Cooperative's respective pass-through mechanism in each of the first six months following the date of this order, as discussed herein. 5. This case is closed and removed from the Commission's Docket. |

Order Entered: 1. Unless otherwise ordered by the Commission, the procedures set forth in 807 KAR 5:001, Section 8, related to the service and electronic filing of papers shall be followed in this proceeding. 2. Pursuant to 807 KAR 5:001, Section 8(9), within seven days of entry of this Order, EKPC shall file a written statement that it waives any right to service of Commission Orders by United States mail and that it or its authorized agent possesses the facilities to receive electronic submissions. 3. Unless a party granted leave to intervene states its objection to the use of electronic filing procedures in a motion for intervention, the party shall: a. Be deemed to have consented to the use of electronic filing procedures and the service of all papers, including Orders of the Commission, by electronic means; and b. Within seven days of the date of an Order of the Commission granting its intervention, file with the Commission a written statement that: (1) It, or its authorized agent, possesses the facilities to receive electronic transmissions; and (2) Sets forth the electronic mail address to which all electronic notices and messages related to this proceeding should be served. 4. If a party objects to the use of electronic filing procedures and the Commission determines that good cause exists to excuse that party from the use of electronic filing procedures, service of documents on that party and by that party shall be made in accordance with 807 KAR 5:001, Section 4(8). |
