Order Entered: 1. Elkhorn District’s amended application is accepted as filed as of March 26, 2025. 2. Elkhorn District shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of service of this Order, Elkhorn District shall notify its customers of the implementation of the rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Elkhorn District shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a request for a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for a decision based upon the existing record. |

Order Entered: 1. The procedural schedule established on November 12, 2024, is amended. 2. Commission Staff’s Report shall be filed no later than March 18, 2025. 3. Elkhorn District shall file its written response, if any, to Commission Staff’s Report within 14 days of the filing of the Commission Staff’s Report. 4. All provisions of the Commission’s November 12, 2024 Order that are in conflict with the provisions of this Order are vacated, and all other provisions not in conflict with the provisions of this Order shall remain in effect. |

Order Entered: 1. The procedural schedule set forth in Appendix A to this Order shall be followed. 2. On or before the date set forth in the procedural schedule, Elkhorn District shall file its responses to the Commission Staff’s request for information, attached to this Order as Appendix B. 3. Elkhorn District shall respond to any additional requests for information propounded by Commission Staff as provided in those requests. 4. No later than the date set forth in the procedural schedule, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Commission Staff’s Report) containing its recommendations regarding Elkhorn District’s requested rate adjustment. 5. No later than 14 days after the date of service of the Commission Staff’s Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings contained in the Commission Staff’s Report; and b. Any additional evidence for the Commission to consider. 6. If Commission Staff recommends that Elkhorn District’s financial condition supports a higher rate than Elkhorn District proposes or the assessment of an additional rate or charge not proposed in Elkhorn District’s application, Elkhorn District in its response to the Commission Staff’s Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the additional rate or charge. |
