Order Entered nunc pro tunc, that: 1. The final paragraph of the Appendix to the Order that reads, “Any person may submit comments on the proposed request no later than 30 days after the date of publication of customer notice. Comments shall be in writing and shall be submitted to the Executive Director, Public Service Commission, 211 Sower Boulevard, P.O. Box 615, Frankfort, Kentucky 40602. Comments may also be submitted by electronic mail to psc.comment@ky.gov. If the Commission does not receive any request for intervention or hearing in this matter within 30 days after the date of publication of this customer notice, the Commission will proceed to render a decision in the matter,” shall be stricken in its entirety and removed from the Appendix to the Order. 2. All other provisions of the Commission’s April 15, 2024 Order that are not in conflict with the terms of this Order shall remain in effect.

Order Entered: 1. Within ten days of the date of service of this Order, North Manchester Water shall notify its customers of the proposed rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory, placing an insert in bill rendered to its customers, or mailing a written notice to each customer. The customer notice shall contain the information set forth in the Appendix to this Order. 2. North Manchester Water shall provide proof of publication of the notice to the Commission no later than 20 days from the date of service of this Order.

Order Entered: 1. North Manchester Water has failed to satisfy the condition precedent required to place its proposed rates into effect subject to 807 KAR 5:076, Section 7. 2. If North Manchester Water provides notice to the Commission of its intent to place its proposed rates into effect pending the final resolution of this matter pursuant to 807 KAR 5:076, Section 7, North Manchester Water shall maintain its records in such manner as will allow the Commission, or any customer, to determine the amounts to be refunded, and to whom, in the event a refund is ordered upon final resolution of this matter.

Order Entered: 1. North Manchester Water’s petition for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. North Manchester Water shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, North Manchester Water shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If North Manchester Water is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.
