Final Order Entered: 1. The rates proposed by Northern Kentucky District are denied. 2. The Phase 1 general service rates and nonrecurring charges set forth in Appendix A to the Order are fair, just and reasonable, and are approved for service rendered on and after the date of this Order. 3. The Phase 2 rates as set forth in Appendix B to this Order are approved for service rendered by Northern Kentucky District effective one year from the date of this Order. 4. One month prior to the effective date of the Phase 2 rates, Northern Kentucky District shall publish notice of the revised rates. 5. Within 45 days of publishing notice required in ordering paragraph 4, Northern Kentucky District shall file proof of notice as required pursuant to 807 KAR 5:076, Section 5(3). 6. Northern Kentucky District’s request to establish a regulatory asset treatment for its reservoir cleaning project is denied. 7. The revised Payment Plan, the removal of the Deposit language, and the other language revisions proposed are approved on and after the date of this Order. 8. Within 20 days of the entry of this Order, Northern Kentucky District shall file with the Commission, using the Commission’s Electronic Tariff Filing System, new tariff sheets setting forth the rates and charges and the revisions approved herein and reflecting their respective effective dates and that they were authorized by this Order. 9. The case is closed and removed from the Commission’s docket.

Order Entered: 1. Northern Kentucky District’s motion for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001E, Section 13(9). 4. Northern Kentucky District shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment.

Order Entered: 1. Northern Kentucky District’s November 16, 2022 motion for an expedited decision is granted. 2. Northern Kentucky District is authorized to issue bonds up to $27,335,000, but no more than the total amount needed to pay off the BAN proposed to be refinanced as identified in the Application. The loan maturity date and interest rate shall be in accordance with the refinancing program as described in Northern Kentucky District's Application. 3. Northern Kentucky District shall execute the bond issuance as authorized herein. 4. Within 30 days of the issuance of the bond, Northern Kentucky District shall file with the Commission the loan documentation with a statement setting forth the date or dates of issuance and terms of the new bond authorized, including the interest rate(s). 5. This case shall remain on the Commission’s docket until such time the Commission issues a further Order in the rate portion of this case.

Order Entered: 1. A hearing in this matter shall be held on October 26, 2022, at 9 a.m. Eastern Daylight Time, in the Richard Raff Hearing Room at the offices of the Public Service Commission at 211 Sower Boulevard, Frankfort, Kentucky. 2. Northern Kentucky Water District (Northern Kentucky District) shall give notice of the hearing in compliance with 807 KAR 5:001, Section 9(2)(b). In addition, the notice of hearing shall include the following statements: “This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov”; and “Public comments may be made at the beginning of the hearing. Those wishing to make oral public comments may do so by following the instructions listed on the PSC website, psc.ky.gov.” At the time the notice is mailed or publication is requested, Northern Kentucky District shall forward a duplicate of the notice and request to the Commission. 3. Pursuant to KRS 278.360 and 807 KAR 5:001, Section 9(9), a digital video transcript shall be made of the hearing.

Order Entered: 1. Northern Kentucky District’s proposed rates are suspended for five months, up to and including January 21, 2023. 2. Northern Kentucky District’s application for approval of the proposed evidence of indebtedness is continued beyond the 60-day period specified in KRS 278.300(2). 4. Any party filing a paper with the Commission shall file an electronic copy in accordance with the electronic filing procedures set forth in 807 KAR 5:001, Section 8. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. 3. The procedural schedule set forth in the Appendix to this Order shall be followed.
