Final Order Entered: 1. This case is opened to address certain outstanding petitions for confidential treatment. 2. The petitions for confidential treatment listed in Appendix B to this Order are granted. 3. The granting of these petitions shall not be cited as precedent in other proceedings before the Commission. 4. All movants shall review the petitions to determine if the material for which confidential treatment was requested still warrants confidential treatment. 5. Order Entered: (1) The intervenors' request for rehearing is granted to the limited extent that the Rate Order is clarified to state that Big Rivers shall begin to draw upon the RER fund when the ER fund is insufficient to fully fund the MRSM. (2) The Intervenors and other interested persons, including but not limited to Century, shall be afforded an opportunity to participate in the management audit by being interviewed and submitting written comments and documents to the auditor. The Intervenors' request for rehearing for the granting of a deviation from 807 KAR 5:013, Section 4, to participate in the management audit as if they were the utility is denied. (3) The management audit required by our Rate Order shall deviate from 807 KAR 5:013, Section 4, to the limited extent that for this audit Big Rivers shall not be permitted to review and comment on the proposals received in response to the Commission's RFP. (4) All other findings and provisions of the Commission's April 25, 2014 Order shall remain in full force and effect.

Final Order Entered: (1) The rates and charges proposed by Big Rivers are denied. (2)The rates in the appendix to this Order are approved for service rendered by Big Rivers on and after February 1, 2014. (3) The depreciation rates proposed by Big Rivers are approved effective as of February 1, 2014. (4) Big Rivers shall continue to defer recording depreciation on the Coleman Station as an expense and record it in a regulatory asset account. All other aspects of Big Rivers' accounting for depreciation on the Coleman Station shall remain unchanged. (5) Effective as of February 1, 2014, Big Rivers shall discontinue recording depreciation of the Wilson Station as an expense and shall defer this depreciation and record it in a regulatory asset account. All other aspects of Big Rivers' accounting for depreciation on the Wilson Station shall remain unchanged. (6) Big Rivers shall prepare a new depreciation study for Commission review by the earlier of five years from the date of this Order or the filing of Big Rivers' next general rate case. (7) Big River's proposed accounting treatment for the transmission revenues related to the Hawesville smelter is approved. (8) Big Rivers' proposal to accelerate the use of the ER and RER funds to mitigate 100 percent of the increase granted in this case is approved. (9) Big Rivers shall be subject to a focused management audit of its efforts to mitigate the impact of the loss of the smelter loads.

Order Entered: 1. Big Rivers’ proposed rates are suspended for six months, up to and including January 27, 2014. 2. The procedural schedule set forth in the Appendix, which is attached hereto and incorporated herein, shall be followed. 3. a. Responses to requests for information shall be appropriately indexed, bound and tabbed. All responses shall include the name of the witness who will be responsible for responding to questions related to the information provided. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or an association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person’s knowledge, information, and belief formed after a reasonable inquiry. c. A party shall make timely amendment to any prior response if it obtains information which indicates that the response was incorrect when made or, though correct when made, is now incorrect in any material respect. d. For any request to which a party fails or refuses to furnish all or part of the requested information, that party shall provide a written explanation of the specific grounds for its failure to completely and precisely respond. 5. Any party filing testimony shall file with the Commission the original and 10 copies.
