Final Order Entered: 1. The recommendations contained in the Commission Staff’s Report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The water service rates proposed by Cunningham District are denied. 3. The Phase 1 water service rates in the Appendix are approved for service rendered by Cunningham District on and after June 25, 2024. 4. The Phase 2 water service rates in the Appendix are approved for service rendered by Cunningham District on and after June 25, 2025. 5. The Nonrecurring Charges set forth in the Appendix are approved for service rendered by Cunningham District on and after June 25, 2024. 6. Cunningham District shall use the midpoint of the depreciable lives of the National Association of Regulatory Utility Commissioners ranges, as proposed in the application and agreed upon by Commission Staff, to depreciate water plant assets for accounting purposes in all future reporting periods. No adjustment to accumulated depreciation or retained earnings should be made to account for this change in the accounting estimate. 7. Within 20 days of the date of service of this Order, Cunningham District shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order. 8. This case is closed and removed from the Commission’s docket.

Order Entered: 1. Cunningham District’s amended application is accepted as filed as of February 9, 2024. 2. Cunningham District shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of service of this Order, Cunningham District shall notify its customers of the implementation of the rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Cunningham District shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of notice of the proposed rates, this case shall stand submitted to the Commission for a decision based upon the existing record.

Order Entered: 1. The procedural schedule set forth in Appendix A to this Order shall be followed. 2. On or before the date set forth in the procedural schedule, Cunningham District shall file its responses to the Commission Staff’s request for information, attached to this Order as Appendix B. 3. Cunningham District shall respond to any additional requests for information propounded by Commission Staff as provided in those requests. 4. No later than the date set forth in the procedural schedule, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Commission Staff’s Report) containing its recommendations regarding Cunningham District’s requested rate adjustment. 5. No later than 14 days after the date of service of the Commission Staff’s Report, each party of record shall file with the Commission: a. Its written comments and any objections to the findings contained in the Commission Staff’s Report; and b. Any additional evidence for the Commission to consider.
