Final Order Entered: (1) The rates proposed by Jackson Energy will produce revenues found to be reasonable herein and are approved. (2) The rates and implementation dates in the Appendix to this Order are approved for service rendered by Jackson Energy. (3) Jackson Energy shall notify the Commission in writing within ten days of all communication with RUS in order for the Commission to be informed of the resolution of Jackson Energy's financial situation. (4) Commencing in 2015, at the same time it files its annual financial report with the Commission, Jackson Energy shall file with the Commission five copies of its annual report on its prepay meter program containing the information as set out in paragraph 5 of the Findings section. (5) Commencing in 2015, at the same time it files its annual financial report with the Commission, Jackson Energy shall file with the Commission five copies of its DSM annual reports which contain the status of each DSM and energy-efficiency program and which contain the information as set out in paragraph 7 of the Findings section. (6) Upon request of Jackson Energy, Commission Staff shall schedule a technical conference to address any questions concerning the requirements set out in this Order. (7) Within 20 days of entry of this Order, Jackson Energy shall file revised tariff sheets setting out the rates approved herein and reflecting the date of issue, the effective date, and that they were approved pursuant to this Order. |

Order Entered: 1. Jackson Energy shall provide a complete notice of its proposed rates to its customers in Breathitt, Garrard, Leslie, Lincoln, Madison, Powell, Pulaski, and Wolfe counties in accordance with 807 KAR 5:001, Section 16(3)(b), by either: (1) including notice with customer bills; (2) publishing notice in a trade publication or newsletter going to all customers in each of those counties; or (3) publishing notice once a week for three consecutive weeks in a prominent manner in a newspaper of general circulation in each service area. The notice provided to its customers shall include the corrections to rates contained in its response to the deficiency letter so that the complete correct notice is provided to its customers in those counties. 2. Jackson Energy shall file with the Commission proof of publication and/or proof of mailing of its notice of proposed rates to its customers in Breathitt, Garrard, Leslie, Lincoln, Madison, Powell, Pulaski, and Wolfe counties as soon as practicable following publication and/or mailing. 3. A hearing in this matter shall be held on Tuesday, January 28, 2014, at 10:00 a.m. Eastern Standard Time, in Heating Room I of the Commission’s offices at 211 Sower Boulevard, Frankfort, Kentucky. 4. Jackson Energy shall publish notice of this hearing in compliance with KRS 424.300 and 807 KAR 5:001, Section 9(2)(b). 5. Jackson Energy shalt file no later than January 24, 2014, proof of publication of its notice of the hearing. |

Order Entered: 1. Jackson Energy's motion for deviation from the filing requirements of 807 KAR 5:001, Section 16(4)(a) is granted. Jackson Energy shall post its corrected notice at its place of business and on its website reflecting the corrections contained in its response to the deficiency letter. 2. Jackson Energy's application is accepted for filing as of the date of this Order. 3. Jackson Energy's rates are suspended for five months from the October 6, 2013 effective date up to and including March 5, 2014. 4. Jackson Energy shall file with the Commission no later than September 27, 2013, a copy of its affidavit(s) of publication and a copy of the notice it was published. 5. The procedural schedule set forth in the Appendix, which is attached hereto and incorporated herein, shall be followed. 6. a. Responses to requests for information shall be filed in accordance with the electronic filing procedures set forth in 807 KAR 5:001, Section 8, and shall be appropriately indexed and bookmarked and shall include the name of the witness responsible for responding to the questions related to the information provided, with copies to all parties of record and a paper copy to the Commission. Any request for information by letter from Commission Staff shall be responded to as if set forth in a Commission Order. |
