Finding that the September 27, 2022 Order shall be amended, the Commission HEREBY ORDERS, nunc pro tunc, that: 1. The statement in the Appendix to the September 27, 2022 Order under Monthly Water Rates, Phase 2, that the surcharge is “To be collected over 48 months or until approximately $177,308 has been collected.” is stricken and is replaced with the following language: “To be collected over 48 months or until approximately $177,304 has been collected.” 2. All other provisions of the Commission’s September 27, 2022 Order that are not in conflict with the terms of this Order shall remain in effect. 3. Within 20 days of the date of service of this Order, Beech Grove Water shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the Phase 1 rates, Phase 2 rates, and the rates and charges approved in the September 27, 2022 Order and as amended herein and their effective date, and stating that the rates and charges were authorized by this Order.

Final Order Entered: 1. The findings contained in the Commission Staff’s Report are adopted and are incorporated by reference into this Order. 2. The water service rates proposed by Beech Grove Water are denied. 3. Phase 1 rates set forth in Appendix B to this Order are approved for services rendered by Beech Grove Water on and after the date of this Order. 4. Phase 2 rates set forth in Appendix B to this Order are approved for services rendered by Beech Grove Water one year following the date of this Order. 5. One month prior to the effective date of the Phase 2 rates, Beech Grove Water shall notify its customers of the implementation of the Phase 2 rates by publishing one-time notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. 6. Within 45 days of publishing notice required in ordering paragraph 5, Beech Grove Water shall file proof of publication of the notice to the Commission as required pursuant to 807 KAR 5:076, Section 5(3). 7. Within 20 days of the date of service of this Order, Beech Grove Water shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the Phase 1 rates, Phase 2 rates, and the rates and charges approved herein and their effective date, and stating that the rates and charges were authorized by this Order.

Order Entered: 1. Beech Grove Water’s amended application is accepted as filed as of July 21, 2022. 2. Beech Grove Water shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of this Order, Beech Grove Water shall notify its customers of the implementation of the rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Beech Grove Water shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for a decision based upon the existing record.

Order Entered: 1. The procedural schedule set forth in the Appendix to this Order shall be followed. 2. No later than the date set forth in the procedural schedule, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Commission Staff’s Report) containing its findings and recommendations regarding Beech Grove Water’s requested rate adjustment. 3. No later than 14 days after the date of the filing of the Commission Staff’s Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings contained in the Commission Staff’s Report; and b. Any additional evidence for the Commission to consider. 4. If Commission Staff finds that Beech Grove Water’s financial condition supports a higher rate than Beech Grove Water proposes or the assessment of an additional rate or charge not proposed in Beech Grove Water’s application, Beech Grove Water in its response to the Commission Staff’s Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the additional rate or charge.
