Final Order Entered: 1. This case is opened to address certain outstanding petitions for confidential treatment. 2. The petitions for confidential treatment listed in Appendix B to this Order are granted. 3. The granting of these petitions shall not be cited as precedent in other proceedings before the Commission. 4. All movants shall review the petitions to determine if the material for which confidential treatment was requested still warrants confidential treatment. 5. A movant shall inform the Commission in writing, and filed in the original case file, if it determines that the information contained in a petition that is granted by this Order no longer warrants confidential treatment. 6. The Commission shall make available for inspection, upon request, any materials that a movant determines no longer warrants confidential treatment. 7. This case is closed and removed from the Commission's docket.

Order Entered: 1. Kentucky Power's June 28, 2013, July 2, 2013, August 16, 2013, and September 23, 2013 petitions for confidential protection are denied as moot. 2. Kentucky Power's May 24, 2013 petition for confidential protection is granted. 3. The designated materials in Kentucky Power's May 24, 2013 petition shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 4. Use of the designated materials of Kentucky Power's May 24, 2013 petition in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 5. Kentucky Power shall inform the Commission if the designated materials of Kentucky Power's May 24, 2013 petition become publicly available or no longer qualify for confidential treatment. 6. If a non-party to this proceeding requests to inspect the designated materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not expired, Kentucky Power shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If Kentucky Power is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Order Entered: 1. Kentucky Power’s request to amend its application is approved. 2. Kentucky Power’s application, as amended, for approval of the terms and conditions of the REPA and authorizing it to enter into the REPA is approved. 3. Kentucky Power’s request to recover the costs for the purchase of renewable energy under the REPA pursuant to KRS 278.271 and via the proposed Tariff B.E.R. is approved. 4. The REPA cost shall be limited to the contract rate as expressed in the REPA. Any additional incremental costs shall be borne by ecoPower, as provided in the REPA, and Kentucky Power’s ratepayers shall be held harmless. 5. Any benefits resulting from Kentucky Power’s decision to bank the RECs associated with the REPA shall be credited to Kentucky Power’s ratepayers. 6. Any net proceeds resulting from Kentucky Power’s decision to sell any RECs associated with the REPA shall be credited to Kentucky Power’s ratepayers. 7. In the event Kentucky Power’s credit rating is negatively impacted by the REPA, causing Kentucky Power to increase its common equity position, Kentucky Power shall hold its ratepayers harmless should such an event occur. 8. Kentucky Power’s request to deviate from the financial exhibit requirements of 807 KAR 5:001, Section 12, is granted. 9. Kentucky Power’s request to deviate from the notice requirements of 807 KAR 5:011, Section 8(2)(b)(3), is granted. 10. Kentucky Power’s motion for rehearing is denied.
