Order Entered: 1. BREC’s March 27, 2024 motion for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for indefinite period or until further order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. If the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment, BREC shall inform the Commission and file with the Commission an unredacted copy of the designated material. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, BREC shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If BREC is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Final Order Entered: 1. BREC’s request to submit this case for a decision on the existing evidence of record without a hearing is granted. 2. BREC’s determination that it had no additional over- or under-recovery for the review periods is approved. 3. The amounts billed by BREC through its environmental surcharge for the six-month billing periods ending January 31, 2020; July 31, 2020; January 31, 2021; January 31, 2022; July 31, 2022; and January 31, 2023; the two-year billing periods ending July 31, 2021, and July 31, 2023, are approved as reasonable. 4. The amounts billed by Jackson Purchase Energy, Kenergy, and Meade RECC through their respective environmental surcharge pass-through mechanisms for the review periods for all customers with dedicated delivery points are approved as reasonable. 5. The amounts billed by the three Member Cooperatives through their respective environmental surcharge pass-through mechanisms for the review periods for all other non-dedicated delivery point customers are approved as reasonable. 6. The rates of return determined by BREC for each month of the review periods are approved as reasonable. 7. This case is closed and removed from the Commission’s docket.

This proceeding is initiated to review BREC’s environmental surcharge and the pass-through mechanism for BREC’s Member Cooperatives for the expense periods set forth in this Order. 2. The procedural schedule set forth in Appendix A to this Order shall be followed. 3. BREC and each of its Member Cooperatives listed in footnote 2 in this Order shall be parties to this case. 4. On or before the date set forth in the procedural schedule, BREC and each of its Member Cooperatives shall file its responses to the information requested in Appendix B attached to this Order. 5. BREC and each of its Member Cooperatives shall respond to any additional requests for information propounded by Commission Staff as provided in those requests. 6.
