Final Order Entered: 1. The record in Case No. 2017-00268, including the Post-Case Correspondence, is incorporated by reference into the record of the instant case. 2. Cumberland Falls District’s request to use $396,502.65 of surplus proceeds from the Assistance Agreement and KIA Loan F16-002 towards Contract No. 3 is granted. 3. The use of the surplus proceeds of KIA Loan F16-002 is authorized for the purposes of funding the water main replacement Project and for the construction of the proposed Project pursuant to Contract No. 3 in the application as submitted in this case. 4. Cumberland Falls District’s request for a declaration that a further CPCN is not required to construct the facilities proposed pursuant to Contract No. 3 is granted. 5. The Commission's August 14, 2017 Order in Case No. 2017-00268 is modified to the limited extent that the KIA financing approved therein is authorized for the purposes of funding the water main replacement project described herein and for the construction of the proposed project in the application as submitted in this case. 6. All provisions of the August 14, 2017 Order that are not in conflict with the terms of this Order shall remain in effect. 7. This case is closed and removed from the Commission's docket. |
