Final Order Entered: 1. The recommendations contained in the Commission Staff’s Report, as modified above, are adopted and incorporated by reference into this Order as if fully set out herein. 2. The water service rates proposed by Breathitt District are denied. 3. The Nonrecurring Charges set forth in Appendix C to this Order are approved for service rendered by Breathitt District on or after the date of this Order. 4. Phase 1 rates set forth in Appendix B to this Order are approved for service rendered by Breathitt District on and after the date of this Order. 5. Phase 2 rates set forth in Appendix B to this Order are approved for service rendered by Breathitt District on and after one year following the date of this Order. 6. One month prior to the effective date of the Phase 2 rates, Breathitt District shall notify its customers of the implementation of the Phase 2 rates by publishing one-time notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. 7. Within 45 days of publishing notice required in ordering paragraph 6, Breathitt District shall file proof of publication of the notice to the Commission as required pursuant to 807 KAR 5:076, Section 5(3) in the post case correspondence, referencing this case number. 8. Phase 3 rates set forth in Appendix B to this Order are approved for service rendered by Breathitt District on and after two years following the date of this Order.

Order Entered: 1. The procedural schedule set forth in Appendix A to this Order shall be followed. 2. On or before the date set forth in the procedural schedule, Breathitt District shall file its responses to the Commission Staff’s request for information, attached to this Order as Appendix B. 3. Breathitt District shall respond to any additional requests for information propounded by Commission Staff as provided in those requests. 4. No later than the date set forth in the procedural schedule, Commission Staff shall file with the Commission and serve upon all parties of record a written report (Commission Staff’s Report) containing its findings and recommendations regarding Breathitt District’s requested rate adjustment.

Order Entered: 1. Breathitt District’s deficiency has been cured and its application is deemed filed on June 6, 2023. 2. Breathitt District shall file proof of publication pursuant to 807 KAR 5:076, Section 5(3) within 45 days of June 6, 2023. The proof of publication shall include an affidavit from the newspaper stating the dates the customer notice was published and copies of the published customer notification showing the published dates. 3. Breathitt District is granted a deviation of 807 KAR 5:076, Section 9 and shall use the 2021 annual report. 4. Nothing contained in this Order shall prevent the Commission from entering further Orders in this matter.
