Final Order Entered: 1. Valley Gas is assessed civil penalties in the total amount of $22,330.37 for the violations identified herein. 2. Valley Gas shall pay $10,000 of the penalties within 30 days of the date of service of this Order by cashier’s check or money order payable to the Kentucky State Treasurer, and mailed or delivered to the Office of the General Counsel, Kentucky Public Service Commission, 211 Sower Boulevard, Post Office Box 615, Frankfort, Kentucky 40602. 3. The remaining civil penalties assessed shall be suspended contingent upon Valley Gas continuing to use a third-party contractor, such as USDI, or another contractor approved in writing by DOI, to ensure compliance with all minimum federal safety standards, for a period of five years. 4. Valley Gas shall file a report annually no later than December 31 of each year, documenting its use of a third-party contractor. 5. The Commission shall consider payment of the suspended portion of the penalties to be satisfied upon Valley Gas’s satisfaction of the conditions discussed above. 6. Any documents filed pursuant to ordering paragraph 4 shall reference this case number and shall be retained in the post-case correspondence file. 7. This case shall be closed and removed from the Commission's docket.

Order Entered: 1. Valley Gas shall submit to the Commission within 30 days of the date of this Order a written response to the allegations contained in the Inspection Report. 2. Valley Gas’s written response shall address the findings of violation in the Inspection Report, the status of remedial measures, and Staff’s proposed assessment in the Demand Letter of a civil penalty. 3. Valley Gas shall appear on May 3, 2022, at 9 a.m., Daylight Savings Time, in the Richard Raff Hearing Room of the Commission’s offices at 211 Sower Boulevard in Frankfort, Kentucky, for the purpose of presenting evidence concerning the alleged violations of 49 C.F.R. Part 192 and 807 KAR 5:027, and of showing cause why it should not be subject to the penalties prescribed in KRS 278.992(1) for these alleged violations. 4. The May 3, 2022 hearing shall be recorded by digital video recording only. 5. The Inspection Report, Valley Gas’ response to the report, and additional materials provided by Valley Gas to Staff are attached as Appendices A, B, and C to this Order and are made a part of the record in this case.
