Final Order Entered: 1. The Joint Applicants are granted a CPCN to construct a wireless telecommunications facility. The proposed facility consists of a tower not to exceed 310 feet in height, with attached antennas, to be located State Route 2194 W, Hickory, Graves County, Kentucky 42051. The coordinates for the proposed facility are North Latitude 36° 50' 23.71" by West Longitude 88° 40' 32.73". 2. The Joint Applicants shall immediately notify the Commission in writing if, after the antenna tower is built and utility service is commenced, the tower is not used for three months in the manner authorized by this Order. 3. Documents filed, if any, in the future pursuant to ordering paragraph 2 herein shall reference this case number and shall be retained in the post-case correspondence file. 4. This case is closed and removed from the Commission’s docket. |

Order Entered nunc pro tunc, that: 1. The first sentence of the September 24, 2021 Order is stricken and is replaced with the following language: On September 15, 2020, Vertical Bridge Development, LLC (Vertical Bridge) and New Cingular Wireless PCS, LLC d/b/a AT&T Mobility (AT&T Mobility) filed an application seeking a Certificate of Public Convenience and Necessity (CPCN) to construct and operate a wireless telecommunications facility in Graves County, Kentucky. 2. The second sentence of the September 24, 2021 Order is stricken and is replaced with the following language: Because more than three residents have requested a local public hearing on Vertical Bridge’s and AT&T Mobility’s application for a CPCN, the Commission, pursuant to KRS 278.650, must convene a local public hearing. 3. All other provisions of the Commission’s September 24, 2021 Order that are not in conflict with the terms of this Order shall remain in effect. |

A local public hearing is convened for the purpose of taking public comment on AT&T Mobility’s application for a CPCN to construct a wireless telecommunications facility to be located at State Route 2194 W, Hickory, Kentucky 42051. 2. The local public hearing shall be held on October 8, 2021, at the Graves County Public Library, 601 N. 17th Street, Mayfield, Kentucky 42066, and shall begin at5 p.m. Central Daylight Time. 3. No evidence shall be taken at the local public hearing. 4. AT&T Mobility shall have a representative present at the local public hearing to answer questions from the public. 5. AT&T Mobility shall publish notice of the time and place of the local public hearing in a newspaper of general circulation in Graves County. 6. AT&T Mobility shall provide written notice of the time and place of the local public hearing to the residents of Graves County that requested the local public hearing, and to the Graves County Judge Executive. |
