Final Order Entered: 1. The rates proposed by Citipower are denied. 2. The rates and charges found reasonable herein, and set forth in the Appendix B to this Order, are approved for service rendered by Citipower on and after the date of this Order. 3. Within 20 days of the date of this Order, Citipower shall file with this Commission, using the Commission's electronic Tariff Filling System, revised tariff sheets setting out the rates approved herein and reflecting that they were approved pursuant to this Order. 4. This case is closed and removed from the Commission's docket. |

Order Entered:1. Citipower's motion to submit is granted with respect to its request for a CPCN to purchase the Herbert White Pipeline and for financing approval and is denied with respect to Citipower's request for a rate increase. 2. Citipower is granted a CPCN to purchase the Herbert White Pipeline as set forth in its application. 3. If Citipower determines that there is a material difference in the facts or expected terms of purchase as compared to those represented in its Application and in response to requests for information, Citipower shall apply for an amendment of the CPCN granted herein. 4. Citipower is authorized to issue the evidences of debt in a principal amount not to exceed $1.5 million subject to the conditions discussed above. 5. The proceeds from the issue of the evidences of debt authorized shall be used only for the lawful purposes set out in the application. 6. Immediately upon entering into an agreement for the purchase of the Herbert White Pipeline, whether conditional or not, Citipower shall notify the Commission by filing a notice of filing in this case; providing a copy of any written agreement; and describing any material terms of the agreement not included in the written agreement. |

Order Entered: 1. Citipower's Motion for Confidential Treatment filed on March 29, 2019, is granted in part and denied in part. 2. The information regarding Champ Oil's operating and maintenance expenses for which confidential treatment was sought meets the criteria for confidential treatment and, therefore, that information shall be exempt from public disclosure for ten years unless Citipower completes its purchase of the pipeline at issue herein in which case the information will be subject to public disclosure at that time. 3. The Letter of Interest for which confidential treatment was sought meets the criteria for confidential treatment and, therefore, the Letter of Interest shall be exempt from public disclosure for ten years. 4. The maps for which confidential treatment was sought meet the criteria for confidential treatment and, therefore, that information shall be exempt from public disclosure for an indefinite period. 5. The use of the information granted confidential treatment herein shall comply with 807 KAR 5:001, Section 13(9). 6. Citipower shall inform the Commission if the information granted confidential treatment herein becomes publicly available or no longer qualifies for confidential treatment. |
