Order Entered: The proposed rates submitted with Jackson Purchase’s application are rejected The approach proposed by Jackson Purchase to allocate its portion of the increase in wholesale rates authorized in Case No. 201 1-00036 is accepted. 3. The rates set forth in the tariff sheets in the Appendix hereto are approved for service rendered on and after September 1, 2011. Jackson Purchase’s revised proposed Non-FAC PPA tariff is approved. Within 20 days of the date of this Order, Jackson Purchase shall file its revised tariffs with this Commission setting out the rates approved herein and stating that they were approved pursuant to this Order. Jackson Purchase revised its proposed Non-FAC PPA tariff in response to Item 2.a. of Commission Staffs First Information Request. Within 60 days of the date of this Order, Jackson Purchase shall refund to its customers with interest all amounts collected for service rendered from September 1, 2011 through the date of this Order that are in excess of the rates set forth in the Appendix to this Order. 7. Jackson Purchase shall pay interest on the refunded amounts at the average of the Three-Month Commercial Paper Rate as reported in the Federal Reserve Bulletin and the Federal Reserve Statistical Release on the date of this Order. Order Entered: (1) Jackson Purchase's proposed rates will be effective the same date as Big River's rates in Case No. 2011-00036. (2) The procedural schedule set forth in the Appendix shall be followed. (3) a. All requests for information and responses thereto shall be appropriately bound and the original and 10 copies shall be filled with the Commission with copies to all parties of record. (3) b. Each response shall be answered under oath. (3) c. A party shall make timely amendment to any prior response. (3) d. For any request to which a party fails to furnish the requested information, that party shall provide a written explanation. (4) Any party filing testimony shall file an original and 10 copies with the Commission with copies to all parties of record. (5) Jackson Purchase shall give notice of the hearing in accordance with the provisions set out in 807 KAR 5:011, Section 8(5). (6) At any public hearing neither opening statements nor summarization of direct testimony shall be permitted. (7) Any objections or motions relating to discovery or procedural dates shall be filed upon four business days notice why such notice was not possible. (8) Motions for extensions of time shall be made in writing. (9) Nothing contained herein shall prevent the Commission from entering further Orders in this matter.
