Order Entered: (1) The Plant Board’s proposed rate for wholesale water service is suspended for five months from December 19, 2010 through May 18, 2011. (2) North Shelby, U.S. 60 District, Peaks Mill, and Elkhorn’s motions to intervene are granted. (3) The procedural schedule set forth in Appendix A shall be followed. (4) a. Responses shall be bound, tabbed, indexed & include the name of witness responding. b. Each response shall be answered under oath or be accompanied by a signed certification. (5) At any hearing, neither opening statements nor summarization of direct testimony shall be permitted. (6) Motions for extensions of time shall be made in writing and will be granted only upon a showing of good cause. (7) All documents that are required to be filed with the Commission shall be served upon all other parties. (8) Service of any document or pleading shall be made in accordance with 807 KAR 5:001, Section 3(7), & Kentucky Civil Rule 5.02. (9) The Plant Board shall file with the Commission, no later than January 7, 2011, the original and 10 copies of the information listed in Appendix B, with a copy to all parties of record. (10) Nothing contained herein shall prevent the Commission from entering further Orders in this matter. |
