Order Entered: Boone District’s motion to amend its application is granted. 2. HBA’s motion to withdraw its objections and request for a hearing in this matter is granted. 3. The hearing scheduled to be held on November 8, 2010 in this matter is hereby cancelled. 4. The charges set forth in the Appendix to this Order are approved as fair, just, and reasonable for services that Boone District renders on and after the date of this Order. 5. Within 20 days of the date of this Order, Boone District shall file a revised tariff sheet reflecting the charges approved herein.

(2) Boone County Water District shall publish notice of this hearing in compliance with KRS 424.300 and 807 KAR 5:011, Section 8 (5). (3) The official record of these proceedings shall be by video only. (4) Pursuant to KRS 278.080 and 807 KAR 5:001, Section 4, the Commission hereby designates James R. Wood as hearing examiner to conduct the scheduled hearing in the above-captioned matter and to perform all actions necessary to ensure the orderly conduct of this hearing, to include administering oaths, receiving evidence, and ruling on motions and objections raised during this hearing.
