Final Order Entered: 1. Marcus Hensley is assessed a fine of one thousand two hundred fifty dollars ($1,250) less the sum of one hundred dollars ($100) previously paid by him for violations of KRS 367.4911 (10) for failure to hand dig or use non-intrusive means to avoid damage to the underground facility of Duke Energy Kentucky, Inc. and for his failure to provide Duke Energy Kentucky, Inc. with notification his intended work and work schedule not less than two (2) nor more than ten (10) working days prior to commencing work. 2. Marcus Hensley shall pay one thousand one hundred fifty dollars ($1,150) by cashier's check or money order payable to the Kentucky State Treasurer and mailed or delivered to the Kentucky Public Service Commission, 211 Sower Boulevard, Frankfort, KY 40602 within thirty (30) days of the date of this order. 3. The Kentucky Public Service Commission will hold a damage prevention training course at its offices located at 211 Sower Boulevard, Frankfort, KY on September 9, 2019 beginning at 1:00 o'clock p.m. and lasting until approximately 3:00 o'clock p.m. Eastern Daylight Time. If Marcus Hensley attends the above training course the additional one thousand one hundred fifty dollars ($1,150) assessed against him in numerical paragraph 2 of this order will be vacated.

Order Entered: 1. Marcus Hensley shall submit to the Commission a written response to the allegations contained in the Staff Incident Report within 20 days of the date of this Order. 2. Marcus Hensley shall appear on August 9, 2019, at 9 a.m., Eastern Daylight Time, in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard in Frankfort, Kentucky, for the purpose of presenting evidence concerning the alleged violation of the Underground Facility Damage Prevention Act, and showing cause why it should not be subject to the penalties prescribed in KRS 367.4917(1) and (4) for this alleged violation. 3. The August 9, 2019 hearing shall be recorded by videotape only. 4. A person shall not file a paper or appear at a hearing on behalf of, or otherwise represent, a partnership, corporation, business entity or other person unless the person is an attorney licensed to practice law in Kentucky. 5. The Staff Incident Report in the Appendix to this Order is made a part of the record in this case.
