Final Order Entered: 1. Valley Gas refund $28,980 to Mago for meter fee overcharges at a rate no less than 36 equal monthly installments beginning no later 30 days of the service of this Order. 2. Valley Gas is ordered to refund $3,473.41 in erroneously collected late fees to affected customers within 90 days of service of this Order. Valley Gas shall make reasonable efforts to locate any customers due refunds who are no longer Valley Gas customers. Valley Gas shall comply with KRS Chapter 393A regarding unclaimed property. 3. For the reasons set forth above, Valley Gas is assessed a civil penalty of $25,000, suspended in total, if Valley Gas complies with this Order regarding its obligation to issue refunds and commits no further willful billing violations within five years of service of this Order. 4. This case is closed and removed from the Commission’s docket. |

Order Entered: 1. Valley Gas’s January 18, 2024 petition for confidential treatment is granted in part and denied in part. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for ten years or until further order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. Valley Gas shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment and the period during which the material has been granted confidential treatment has not expired, Valley Gas shall have 30 days from receipt of written notice of request to demonstrate the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Valley Gas is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make requested material available for inspection for 30 days from service of an Order finding that the material no longer qualifies for confidential treatment in order to allow Valley Gas to seek a remedy afforded by law. |

Order Entered: 1. This proceeding is established to investigate whether Valley Gas is in violation of KRS 278.160 or any possible willful violation by Valley Gas of previous Commission Orders in Case Nos. 2014-00368 or 2020-00085. 2. Within 20 days of the date of service of this Order, Valley Gas shall cause to be filed an entry of appearance by an attorney licensed in Kentucky. 3. Within 20 days of the date of service of this Order, said attorney shall, on behalf of Valley Gas, submit to the Commission a written response to the allegations set forth in this Order. 4. The procedural schedule set forth in Appendix A to this Order shall be followed. This schedule shall be amended if any intervenors are joined. 5. Valley Gas shall respond to requests for information propounded by Commission Staff by the date set forth on the request, whether the request appears on the procedural schedule. 6. All documents, records, and Orders included in the record of Case No. 2014-00368, Case No. 2022-00315, and Case No. 2020-00085 are incorporated by reference into the record of this proceeding. 7. Any party filing a paper with the Commission shall file an electronic copy in accordance with the electronic filing procedures set forth in 807 KAR 5:001, Section 8. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. |
