Order Entered: 1. This proceeding is expanded to include Nicholas District’s alleged failure to comply with Commission regulation 807 KAR 5:006, Section 4(2). 2. The style of this proceeding is amended to: Electronic Investigation into Nicholas County Water District for an Alleged Failure to Comply with a Commission Order, 807 KAR 5:006, Section 4(2), and KRS 278.160. 3. Within 30 days of the date of service of this Order, Nicholas District shall file, by and through counsel an answer to the allegations contained in this Order and the October 3, 2023 Order initiating this proceeding. |

Order Entered: 1. The Commission’s May 26, 2023 Order in Case No. 2023-00114 is revoked in its entirety. 2. Within ten days of the date of service of this Order Nicholas District shall file with the Commission using the electronic Tariff Filing System, revised tariff sheets the rates approved in Case No. 2023-00024 and appearing in Appendix A attached to this Order. 3. Within 20 days of the date of service of this Order, and subsequent to the action required by ordering paragraph two of this Order, Nicholas District shall file with the Commission using the electronic Tariff Filing System revised tariff sheets showing the rates appearing in Appendix E attached to this Order. 4. Within 20 days of the date of service of this Order, Nicholas District shall provide notice to its customers of the rates appearing in Appendix E by publishing a one- time notice of the rates in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. 5. Nicholas District shall respond to requests for information propounded by Commission Staff as provided in those requests. 6. Nicholas District shall file any PWA application following its filing of tariff sheets as directed in this Order. |
