Order Entered: 1. Northern Kentucky District’s motion for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. Northern Kentucky District shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Northern Kentucky District shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Northern Kentucky District is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Final Order Entered: 1. Northern Kentucky District is granted a CPCN to construct the proposed project as set forth in the application. 2. Northern Kentucky District shall obtain approval from the Commission prior to performing any additional construction not expressly approved by this Order. 3. Northern Kentucky District shall require construction to be inspected under general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with best practices of the construction trades involved in the project. 4. Northern Kentucky District is authorized to enter the proposed Assistance Agreement with KIA and, under the terms of the Assistance Agreement, to borrow from KIA an additional $4,000,000. The total SRF F13-012 KIA Loan will not exceed $8,000,000 and will be repaid over a 20-year term at an interest rate of 1.75 percent per annum. 5. Within 30 days of executing the proposed Assistance Agreement with KIA, Northern Kentucky District shall file with the Commission an executed copy of the Assistance Agreement.
