Order Entered: 1. Green River Solar’s motion for confidential treatment for the material terms of leases provided in response to Staff’s First Request Item 24(b) is granted. 2. Green River Solar’s motion for confidential treatment for the easements provided in response to Staff’s First Request Item 3(b) is denied. 3. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for ten years or until further order of this Siting Board. 4. Use of the designated material granted confidential treatment by this Order in any Siting Board proceeding shall comply with 807 KAR 5:110, Section 5. 5. Green River Solar shall inform the Siting Board if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 6. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Green River Solar shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Green River Solar is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Siting Board shall deny the request for inspection.

Final Order Entered: 1. Green River Solar’s Request for Deviation from KRS 278.704(2) for the portion of the Project located in Breckinridge County is granted. 2. Green River Solar’s application for a Certificate to Construct an approximately 200 MWac merchant solar electric generating facility in Breckinridge County and Meade County, Kentucky, is conditionally granted subject to full compliance with the mitigation measures and conditions prescribed in Appendix A to this Order. 3. Within 30 days of entry, Green River Solar will send a copy of this Order to all the adjoining landowners who previously were required to receive notice of the Project. At least 30 days prior to construction it will notify residents and businesses within 2,400 feet of the Project boundary about the construction plan and the complaint resolution process. 4. Green River Solar shall fully comply with the mitigation measures and conditions in Appendix A. 5. In the event mitigation measures within the body of this Order conflict with those prescribed in Appendix A, the measures in Appendix A shall control. 6. This case is closed and removed from the Commission’s docket.
