Order Entered: 1. Salt River Electric’s motion for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. Salt River Electric shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Salt River Electric shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Salt River Electric is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Final Order Entered: 1. Salt River Electric may resume disconnections for nonpayment consistent with this Order. 2. This case is closed and removed from the Commission’s docket.

Order Entered: 1. A hearing in this matter shall be held on November 24, 2020, at 9 a.m. Eastern Standard Time, in the Richard Raff Hearing Room (Hearing Room 1) at the offices of the Public Service Commission at 211 Sower Boulevard, Frankfort, Kentucky. 2. Salt River Electric Cooperative Corp. (Salt River Electric) shall give notice of the hearing in compliance with 807 KAR 5:001, Section 9(2)(b). In addition, the notice of hearing shall include the following statements: "This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov"; and "Public comments may be made at the beginning of the hearing. Those wishing to make oral public comments may do so by following the instructions listed on the PSC website, psc.ky.gov." At the time the notice is mailed or publication is requested, Salt River Electric shall forward a duplicate of the notice and request to the Commission. 3. Pursuant to KRS 278.360 and 807 KAR 5:001, Section 9(9), a digital video transcript shall be made of the hearing.

The last sentence of the first paragraph on page 6, is stricken and is replaced with the following language: Unless Salt River Electric's billing cycle ended on October 2, 2020, Salt River Electric mailed its bills that day, and postpay members failed to pay both the current bill for service rendered after October 1, 2020, and the payment under the partial payment plan, the conceivably earliest date Salt River Electric could begin disconnections of its postpay members would be October 29, 2020. 2. All other provisions of the Commission's October 22, 2020 Order that are not in conflict with the terms of this Order shall remain in effect.

Order Entered: 1. This proceeding is initiated to investigate and examine Salt River Electric's Board's, and Executive Officer's possible violations of: the Commission's Orders in Case No. 2020-00085 entered on September 21, 2020, and September 30, 2020; Salt River Electric's tariff provisions governing disconnection procedures; and 807 KAR 5:006, Section 15(f). 2. Salt River Electric, Jimmy Longmire, A.C. "Happy" Cahoe, Linda West, Gayle Troutman, Darrell Tingle, Garry Mann, and Tim Sharp are made parties to this proceeding. 3. The electronic filing procedures set forth in 807 KAR 5:001, Section 8, shall be used in the processing of this matter. 4. No later than 11:59 Eastern Daylight Time October 23, 2020, Salt River Electric shall file with the Commission: a. Responses to the allegations that Salt River Electric has violated its tariff procedures for disconnections; b. Responses to the allegations that Salt River Electric violated 807 KAR 5:006; c. Responses to the allegations that Salt River Electric violated the Commission's Orders entered in Case No. 2020-00085. d. Thorough descriptions of Salt River Electric's attempts to contact its members regarding partial payment plans, as well as detailed descriptions of Salt River Electric's efforts to notify its customers of the availability of payment plans.
