Final Order Entered: 1. The rates proposed by Clark Energy are denied. 2. The rates set forth in Appendix B to this Order are approved for services rendered by Clark Energy on and after the date of this Order. 3. Within 20 days of the date of entry of this Order, Clark Energy shall file with the Commission, using the Commission's electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved herein and reflecting their effective data and that they were authorized by this Order. 4. This case is closed and removed from the Commission's docket. |

Order Entered: 1. Clark Energy's rates are suspended for five months from June 1, 2020, until November 1, 2020. 2. Clark Energy is granted a deviation from the requirements of 807 KAR 5:001, Section 12(1)(a) and 807 KAR 5:001, Section 16(1)(b)(2), (4)(j)-(s), 4(v), and 5(b)-(d). 3. Clark Energy's 20184 and 20195 annual reports are incorporated by reference into the record of this proceeding. 4. Requests for intervention shall be filed no later than May 29, 2020. 5. Order Entered: 1. The Attorney General is granted intervention in this proceeding. 2. The Attorney General shall be entitled to the full rights of a party and shall be served with the Commission's Orders and with filed testimony, exhibits, pleadings, correspondence, and all other documents submitted by parties after the date of this Order. 3. The Attorney General shall comply with all provisions of the Commission's regulations, 807 KAR 5:001, Section 8, related to the service and electronic filing of documents. 4. Pursuant to 807 KAR 5:001, Section 8(9), within seven days of entry of this Order, the Attorney General shall file a written statement with the Commission that: a. Certifies that it, or its agent, possesses the facilities to receive electronic transmissions; and b. Sets forth the electronic mail address to which all electronic notices and messages related to this proceeding should be served. 5. Any comments regarding whether this application should be processed under the streamlined procedure shall be filed within seven days of the date of this Order. 6. The Commission directs the Attorney General to the Commission's March 16, 2020 and March 24, 2020 Orders in Case No. 2020-00085 regarding filings with the Commission. The Commission expects the original documents to be filed with the Commission within 30 days of the lifting of the current state of emergency. |
