Order Entered: 1. Duke Kentucky's petition for confidential protection for Response 5 is granted. 2. The designated information shall not be placed in the public record or made available for ten years, or until further Order of this Commission. 3. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. Duke Kentucky shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, then Duke Kentucky shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Duke Kentucky is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the requested material available for inspection for 30 days following an Order finding that the material no longer qualifies for confidential treatment in order to allow Duke Kentucky to seek a remedy afforded by law.

Final Order Entered: 1. The charges and credits billed by Duke Kentucky through its FAG for November 1, 2018, through April 30, 2019, except for costs related to the GreenHat default, are approved. 2. Beginning with the expense month for May 2020, Duke Kentucky should credit an amount equal to $53,085.99 for three months until August 2020. 3. This case is closed and removed from the Commission's docket.

Order Entered: 1. Duke Energy Kentucky, Inc. (Duke Kentucky) shall appear in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, on October 15, 2019, at 9 a.m. Eastern Daylight Time, to submit itself to examination on the application of its Fuel Adjustment Clause (FAC) from November 1, 2018, through April 30, 2019. Neither opening statements nor summaries of pre-filed testimony will be permitted. 2. Not less than 7 days and no more than 21 days prior to the scheduled hearing, Duke Kentucky shall publish, in a newspaper of general circulation in each area in which it serves, notice of the purpose, time, place, and date of the scheduled hearing. In addition, the notice of hearing shall include the following statement: "This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov." 3. Duke Kentucky shall file with the Commission no later than October 14, 2019, proof of publication of its notice for the hearing. 4. The official record of the proceeding shall be by digital video recording only. 5. a. The information requested in the Appendix to this Order is due no later than 14 days from the date of entry of this Order. Responses to requests for information in paper medium shall be appropriately bound, tabbed, and indexed. Electronic documents shall be in portable document format (PDF), shall be searchable and shall be appropriately bookmarked.
