Final Order Entered: 1. Kentucky Power's September 10, 2018 application is granted in part and denied in part. 2. Kentucky Power's request for a declaration that Grid Assurance is not a Kentucky Power affiliate is denied. 3. Kentucky Power's request for deviation from KRS 278.2207 to enter into the Grid Assurance Subscription Agreement and pay its Contract Allocated Share is granted in part, subject to the limitations in the Appendix. 4. Kentucky Power's request for deviation from KRS 278.2207 to purchase equipment from Grid Assurance upon Qualifying Events at Original Cost, when comparable equipment is subject to lead times that would result in a delay in restoring the affected equipment that would negatively affect consumers, is granted. 5. Kentucky Power's request for deviation from KRS 278.2207 to purchase equipment from Grid Assurance through a Discretionary Sale is denied without prejudice to Kentucky Power's ability to request deviation for specific purchases. 6. Kentucky Power shall provide final transfer, or if applicable, acquisition details, within 30 days of any Qualifying Event transaction occurring under the terms of the Grid Assurance agreement and shall supplement such initial reporting with subsequent final documents. 7. Any documents filed pursuant to ordering paragraph 6 of this Order shall reference the number of this case and shall be retained in Kentucky Power's post-case correspondence files. |

Order Entered: 1. Kentucky Power's September 10, 2018 motion for confidential treatment is granted, in part, and denied, in part. 2. Kentucky Power failed to establish the pricing information on pages 3 and 4 of Exhibit 3 to its Application meet the criteria for confidential treatment and, therefore, those materials shall be made available to the public. 3. The remaining materials for which confidential treatment was sought meet the criteria for confidential treatment and, therefore, shall not be made available to the public for an indefinite period unless the Commission orders otherwise. 4. Kentucky Power shall inform the Commission if the materials granted confidential protection become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect materials granted confidential treatment by this Order, Kentucky Power shall have 20 days from receipt of written notice of the request to demonstrate the materials are exempt from disclosure, pursuant to KRS 61.878. If Kentucky Power is unable to make such demonstration or the non-party establishes an exemption does not apply, the requested materials shall be made available for inspection. 6. The Commission shall not place the documents and materials for which confidential treatment was denied into the public record for a period of 30 days pursuant to 807 KAR 5:001, Section 13(5). |
