Order Entered: 1. LG&E's February 24, 2017 motion for confidential treatment is granted. 2. The designated materials for which LG&E seeks confidential treatment in its February 24, 2017 motion shall not be placed in the public record or made available for public inspection for five years or until further Orders of this Commission. 3. Use of the materials in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. LG&E shall inform the Commission if the materials in question become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect the materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not run, then LG&E shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If LG&E is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the requested materials available for inspection for 30 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow LG&E to seek a remedy afforded by law. |

Final Order Entered: 1. LG&E is authorized to execute, deliver, and perform its obligation under its Mortgage Indenture, whereby it may issue in one or more series First Mortgage Bonds during the remainder of 2017 in an aggregate principal amount up to $300 million as described in its application. The proceeds shall be used for the purposes as set out in its application. 2. LG&E is authorized to issue its First Mortgage Bonds in one or more series and at one or more times and to execute, deliver and perform its obligations under the loan agreements with Trimble County, Kentucky, and under any other agreements and documents, and to perform the transactions contemplated by all such agreements, including, but not limited to, borrowings or advances, and the related repayment or reimbursement obligations, all as set out in its application, in total principal amounts not to exceed $60 million. 3. LG&E is authorized to deliver and perform its obligations under hedging agreements and other agreements and documents, to perform transactions contemplated by all such agreements, and to establish regulatory assets or liabilities for the losses and gains arising from hedging facilities and amortize the losses and gains over the remaining life of bonds, as described in its application. The establishment of regulatory assets or liabilities is for accounting purposes only, and any rate impact will be determined in a future rate proceeding. |
