Order Entered: 1. Whitley District #1 's February 8, 2017 petition for confidential protection is granted. 2. The designated materials shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. Whitley District #1 shall inform the Commission if the designated materials become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect the designated materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not expired, Whitley District #1 shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If Whitley District #1 is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the designated materials available for inspection for 30 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow Whitley District #1 to seek a remedy afforded by law.

Final Order Entered: 1. Whitley County is granted a CPCN to proceed with the proposed construction as set forth in its application. 2. Whitley County shall notify the Commission prior to performing any additional construction not expressly authorized by this Order. 3. Any deviation from the construction approved by this Order shall be undertaken only with the prior approval of the Commission. 4. Whitley County shall require construction to be inspected under the general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with the best practices of the construction trades involved in the project. 5. Whitley County is authorized to enter into the proposed Assistance Agreement with KIA and, under the terms of the Assistance Agreement, to borrow from KIA an amount not to exceed $932,500 to be repaid over a 20 year period at an interest rate of 0. 75 percent per annum with a loan servicing fee of 0.25 percent of the annual outstanding loan balance payable to KIA with each interest payment. 6. Within 30 days of executing its proposed Assistance Agreement with KIA, Whitley County shall file with the Commission an executed copy of the Assistance Agreement. Whitley County shall use $932,500 of proceeds from proposed Assistance Agreement with KIA only for the lawful purposes set forth in its application.
