Order Entered: 1. BREC's petition for confidential protection for its responses to the requests for information contained in the Appendix to the Commission's Order dated August 12, 2016, is granted. 2. The designated materials in BREC's response, Item 5, shall not be placed in the public record or made available for public inspection for five years, or until further Orders of this Commission. 3. The designated materials in BREC's response, Item 24, shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 4. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001, section 13(9). 5. BREC shall inform the Commission if the designated materials become publicly available or no longer qualify for confidential treatment. 6. If a non-party to this proceeding requests to inspect the designated materials and the period during which the materials have been granted confidential treatment has not expired, BREC shall have 20 days from receipt of written notice of the request to demonstrate that the designated materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If BREC is unable to make such demonstration, the designated materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Final Order Entered: The charges and credits billed by Big Rivers through its FAG for the period November 1, 2015, through April 30, 2016, are approved.

Order Entered: 1. Big Rivers Electric Corporation ("Big Rivers") shall appear in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, on November 9, 2016, at 9:00a.m. , Eastern Standard Time, to submit itself to examination on the application of its Fuel Adjustment Clause ("FAC") from November 1, 2015, through April 30, 2016. Neither opening statements nor summaries of pre-filed testimony will be permitted. 2. Not less than seven days and no more than 21 days prior to the scheduled hearing, Big Rivers shall publish in a newspaper of general circulation in each area in which it serves notice of the purpose, time, place, and date of the scheduled hearing. In addition, the notice of hearing shall include the following statement: "This hearing will be streamed live and may be viewed on the PSC website, psc.ky.gov." 3. Big Rivers shall file with the Commission no later than November 7, 2016, proof of publication of its notice for the hearing. 4. The official record of the proceeding shall be by video only.
