Order Entered: 1. Movant's motion for confidential protection is granted. 2. The information relating to Movant's negotiated balance thresholds with interstate pipelines for which Movant seeks confidential treatment shall not be placed in the public record or made available for public inspection from the date of the Order until April 24, 2019, at which time the materials will be placed in the public record. Movant may request that the materials continue to be treated as confidential but must demonstrate that the materials still fall within the exclusions established in KRS 61.878. 3. If Movant objects to the time limits that the Commission has placed on the confidential treatment for the materials in question, it must seek either rehearing pursuant to KRS 278.400 or judicial review of this Order pursuant to KRS 278.410. Failure to exercise either of these statutory rights will be deemed as agreement with the Commission's determination of the period for which the material is afforded confidential treatment and will require Movant to demonstrate a change in circumstances in any subsequent motion for continued confidential treatment of the material in question after the end of the period set forth in ordering paragraph 2. 4. Use of the materials in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9).

The coal bid analysis and tabulation sheets for which Movant seeks confidential treatment shall not be placed in the public record or made available for public inspection from the date of the Order until February 28, 2024, at which time the materials will be placed in the public record. Movant may request that the materials continue to be treated as confidential but must demonstrate that the materials still fall within the exclusions established in KRS 61.878. 3. If Movant objects to the time limits that the Commission has placed on the confidential treatment for the materials in question, it must seek either rehearing pursuant to KRS 278.400, or judicial review of this Order pursuant to KRS 278.410. Order Entered: 1. Duke Energy Kentucky ("Duke Kentucky") shall appear in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, on April 10, 2014, at 10:00 a.m., Eastern Daylight Time, to submit itself to examination on the application of its Fuel Adjustment Clause ("FAC") from May 1, 2013, through October 31, 2013. Neither opening statements nor summaries of pre-filed testimony will be permitted. 2. Not less than seven days and nor more than 21 days prior to the scheduled hearing, Duke Kentucky shall publish, in a newspaper of general circulation in each area in which it serves, notice of the purpose, time, place and date of the scheduled hearing. 3. Duke Kentucky shall file with the Commission no later than April 7, 2014, proof of publication of its notice for the hearing. 4. The official record of the proceeding shall be by video only. 5. a. The information requested in the Appendix to this Order is due no later than 21 days from the date of this Order. Responses to requests for information shall be appropriately bound, tabbed and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided.
