Order Entered: 1. The designation of American Broadband as a limited ETC is conditioned on American Broadband's compliance with: (1) the representations and commitments made by American Broadband in its ETC application and its Compliance Plan; and (2) the FCC rules, including those adopted by the FCC in the Lifeline Reform Order. 2. American Broadband is designated as a limited ETC for the purpose of offering Lifeline service only in the underlying carrier's licensed service areas in Kentucky. 3. During the current certification period, American Broadband shall be eligible to receive federal USF support for Lifeline. 4. American Broadband shall advertise the availability of and charges for these services using media of general distribution. 5. American Broadband shall comply with the FCC's annual certification process for Lifeline customers. 6. American Broadband is a utility as defined by KRS 278.010(3)(e) and shall comply with the requirements set forth in KRS 278.130 to KRS 278.150. 7. A copy of this Order shall be served upon the FCC and the USAC.
