Order Entered: Except where they contradict or conflict with the findings contained in this Order, the findings contained in Commission Staffs report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The rates set forth in the Appendix to this Order are approved for water service that Cunningham District renders on and after the date of this Order. Every 90 days from the date of this Order until final action by Carlisle County Fiscal Court, Cunningham District shall file with the Commission a written report on its efforts to obtain the Carlisle County Fiscal Court’s authorization for a monthly salary for the members of its Board of Commissioners. This report shall include a copy of the minutes of any meeting of Carlisle County Fiscal Court in which Cunningham District’s request is discussed or acted upon. 4. Within 20 days of the date of this Order, Cunningham District shall file revised tariff sheets with the Commission setting forth the rates approved in this Order. 5. Any documents filed in the future pursuant to ordering paragraph 3 of this Order shall reference this case number and shall be retained in the utility’s general Correspondence file.

Order Entered: 1. The Commission’s Order of December 22, 2012 is hereby modified and amended. All provisions of the earlier Order that conflict with the provisions of this Order are stricken. All remaining provisions remain in effect. 2. No later than April 16, 2012, Commission Staff shall file with the Commission and serve upon all parties of record a written report containing its findings and recommendations regarding Cunningham District’s requested rate adjustment. 3. The parties shall file with the Commission their written comments on and any objections to the findings and recommendations contained in the Commission Staff Report no later than April 30, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier. Any party may file with such submission any additional evidence for the Commission’s consideration. 4. A party’s failure to file written objections to a finding or recommendation contained in the Commission Staff Report by April 30, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier, shall be deemed as agreement with that finding or recommendation. 5. No later than April 30, 2012, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier, each party shall notify the Commission in writing whether this matter may be submitted for decision based upon the existing record without hearing. 6. Order Entered: (1) This proceeding is established to review reasonableness of Cunningham District’s proposed rates. (2) No later than 3/15/2012 Staff shall file written report containing its findings & recommendations. (3) Parties shall file written comments and any objections to Staff Report no later than 3/29/2012 or 14 days after the filing of Staff Report, whichever occurs earlier. (4) A party’s failure to file objections shall be deemed as agreement. (5) No later than 3/29/2012 or 14 days after filing of Staff Report each party shall notify Commission whether matter may be submitted for decision based upon the existing record w/o hearing. (6) Unless all parties request matter be submitted for decision upon the existing record, an IC shall be held on 4/04/2012 at 1:30 p.m., EST. (7) Unless all parties request matter be submitted for decision upon existing record, a formal hearing shall be held at date & time to be announced in a subsequent Order. (8) Each party shall file no later than 4/13/2012 a list of persons it intends to call as witnesses & summary of each witness’s testimony. (9) Cunningham District shall publish notice of hearing in accordance with 807 KAR 5:076, Section 11, no more than 21 days and no less than seven days before the hearing. (10) Pursuant to KRS 278.360, the record on hearing shall be by videotape. (11) Staff shall make a written exhibit list and file list with the Commission with exhibits and a copy of the video transcript of the hearing.
