South KY RECC's Response to Info Requested per Settlement Agreement

Order Entered: (1) The Joint Stipulation of Facts and Settlement Agreement is adopted and approved in its entirety as a complete resolution of all issues in this case. (2) South Kentucky is assessed a penalty of $2,500.00. (3) South Kentucky shall pay $1,500.00 of the $2,500.00 civil penalty within 30 days of the date of this Order. (4) The remaining $1,000,000 of the civil penalty is suspended on the condition that South Kentucky abide by the terms contained in the Settlement Agreement, provide all required documentation within the time allotted and does not have any related reportable incidents investigated by the PSC. (5) Within 30 days of the date of this Order, South Kentucky shall provide documentation on the safety meeting conducted on June 21, 2011. (6) Within 30 days of the date of this Order, South Kentucky shall provide minutes from its August 25, 2010 hazardous recognition training . (7) On or before February 1, 2012, South Kentucky shall provide a summary report of the 50 clearance issues that have been found by South Kentucky since 2008.

Order Entered: (1) South Kentucky RECC shall submit to the Commission, within 20 days of the date of this Order, a written response to the allegations contained in the Report. (2) South Kentucky RECC shall appear on January 24, 2012 at 10:00 a.m. EST, in Hearing Room 1 of the Commission's offices for the purpose of presenting evidence concerning the alleged violations of KRS 278.042 and of showing cause why it should not be subject to the penalties prescribed in KRS 278.990(1) for these alleged violations. (3) At the scheduled hearing in this matter, South Kentucky RECC shall also present evidence on the adequacy, safety, and reasonableness of its practices related to the construction, installation and repair of electric facilities as they relate to the facts of this case and whether such practices require revision. (4) The January 24, 2012 hearing shall be recorded by videotape only. (5) The Report in the Appendix hereto is made a part of the record in this case. (6) Any requests for an informal conference with Commission Staff shall be set forth in writing and filed with the Commission within 20 days of the date of this Order.
