Order Entered: I. Woodland Acres motion for a continuance is granted. Woodland Acres shall appear in Hearing Room 1 of the Commission’s offices, on June 28, 2012 at 10:00 a.m., for the purposes of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with the Commission’s February 29, 201 2 Order. 2. a. Written testimony shall be filed in response to the information requested in the Appendix to this Order and is due no later than June 21 , 2012. b. Each response shall be answered under oath. c. A party shall make timely amendment to any prior response. d. Any request a party refuses to furnish the requested information, that party shall provide a written explanation. 3. If for any reason Woodland Acres fails to appear at the Hearing scheduled for June 28, 2012, then this case shall be submitted for a decision on the record based on the written testimony provided in response to the information requested in the Appendix to this Order. 4. If written testimony provided in response to the information requested in the Appendix to this Order is not filed by June 21, 2012, and Woodland Acres does not appear at the June 28, 2012 Hearing, then a subpoena shall be issued for Mr. Joe Murphy through Franklin Circuit Court. Failure of Mr. Murphy to answer the subpoena shall result in the Commission requesting a bench warrant for Mr. Murphy’s arrest through Franklin Circuit Court.

Order Entered: that Woodland Acres shall appear on May 9, 2012, at 1O:OO a.m. Eastern Daylight Time, in Hearing Room 1 of the Commission’s offices at 21 1 Sower Boulevard, Frankfort, Kentucky, for the purposes of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with the Commission’s February 29, 2012 Order.

Order Entered: I. Woodland Acres’ Third Amended Motion for Extension of Time to File Required Reports is granted. 2. Woodland Acres is granted an extension of time, up to and including February 29, 2012, to file its required financial and statistical reports and gross operating reports for calendar years 2009 and 2010. 3. Unless undue hardship or exceptional circumstances can be factually demonstrated by Woodland Acres, no further extensions of time will be granted to file its required financial and statistical reports and gross operating reports for calendar years 2009 and 2010. 4. Woodland Acres’ failure to file the required reports within the time period specified by this Order will subject it to additional civil penalties.

Order Entered: (1) Woodland Acres Second Amended Motion for Extension of Time to File Required Reports is granted. (2) Woodland Acres is granted an extension of time up to and including January 31, 2012 to file its required financial and statistical reports and gross operating reports for calendar years 2009 and 2010. (3) Any further extensions of time to file will be granted only upon a showing of undue hardship or exceptional circumstances. (4) Woodland Acres' failure to file the required reports by January 31, 2012 or such later date if an extension is granted pursuant to Ordering Paragraph 3, will be considered a violation of this Order for purposes of assessing a penalty under KRS 278.990.

Woodland Acres 2nd Amended Motion for Extension of Time

Order Entered: (1) Woodland Acres' Amended Motion for Extension of Time to File Required Reports is granted. (2) Woodland Acres is granted an extension of time up to and including December 31, 2011 to file its required financial and statistical reports and gross operating reports for calendar year 2010. (3) Woodland Acres is required to file its annual sewer reports and sewer gross operating reports for the 2009 and 2010 calendar years only. (4) Woodland Acres is assessed a civil penalty of $250. (5) Woodland Acres' failure to file the required reports and submit the required civil penalty within the time period specified by this Order will subject it to additional civil penalties.

Order Entered: (1) Woodland Acres shall file with the Commission, no later than October 20, 2011, its annual reports and gross operating reports for the 2009 and 2010 calendar years. (2) Woodland Acres shall appear on October 27, 2011 at 10:00 a.m. in Hearing Room 1 of the Commission's offices for the purpose of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with KRS 278.140 and 278.230(3). (3) If Woodland Acres desires to waive its right to a hearing in this matter, it shall, no later than October 20, 2011 file the required reports and pay a penalty of $250.
