Final Order Entered: (1) B&H Gas is assessed a penalty of $2,500 for its willful failure to comply with KRS 278.230. (2) B&H shall pay the assessed penalty within 14 days of the date of this Order. Payment shall be made by certified check or money order made payable to "Kentucky State Treasurer" and shall be mailed or delivered to the Office of General Counsel, Kentucky Public Service Commission, 211 Sower Boulevard, P. 0. Box 615, Frankfort, Kentucky 40602-0615. (3) Within 20 days of the date of this Order, B&H Gas shall file with the Commission a signed, notarized copy of its annual financial and statistical report for its 2010 calendar year operations.

Order Entered: (1) B & H Gas Company shall file with the Commission, no later than October 20, 2011, its gas distribution annual report for the 2010 calendar year. (2) B & H Gas Company shall appear on October 27, 2011 at 10:00 a.m. in Hearing Room 1 of the Commission's offices for the purpose of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with KRS 278.230(3). (3) If B & H Gas Company desires to waive its right to a hearing, it shall, no later than October 20, 2011, file the required report and pay a penalty of $250.00
