Order Entered: The charges and credits applied through the FAC for the period from November 1, 2008 through October 31, 2010 are approved. 2 Except for direct served customer. shall deduct 6.67 mills per kWh from its base energy rates (as adjusted for line loss) to reflect the transfer (roll-in) of a negative 6.39 mills per kWh of fuel costs by East Kentucky to its base energy rates as approved in 2010- 00491. As there is no line loss adjustment for direct served customers shall deduct 6.39 mills per kWh from the base energy rate applicable to its direct served customer 3. The rates in the Appendix to this Order are approved for service rendered on and after June 1,2011, the effective date of East Kentucky’s change in rates. 4. Within 20 days of the date of this Order, shall file revised tariff sheets with the Commission setting out the rates approved herein and reflecting that they were approved by this Order.

Order Entered: 1. A public hearing shall be held on March 22, 2011 at 1O:OO a.m., Eastern Daylight Time, at the Commission’s offices in Frankfort, Kentucky, to examine the application of the Fuel Adjustment Clause of Fleming-Mason Energy Cooperative (“Fleming-Mason”) from November 1, 2008 through October 31, 2010. If no interested party files written notice of its intent to attend this hearing with the Commission by March 18, 2011, the public hearing shall be cancelled and the matter shall be considered submitted for decision based on the evidence in the record. 2. Fleming-Mason shall file an affidavit with the Commission no later than 21 days from the date of this Order attesting to its compliance or noncompliance with the requirements of 807 KAR 5:056. 3. All documents that Fleming-Mason filed with the Commission pursuant to 807 KAR 5:056, Section 1 (7) and (9), during the period under review are incorporated by reference into the record of this proceeding 4. Fleming-Mason shall publish the following notice not less than 7 days or more than 21 days prior to the public hearing in a newspaper of general circulation in its service areas or in a trade publication or newsletter going to all customers.
