Final Order Entered: (1) The charges and credits applied by Duke Kentucky through the FAC for the period from November 1, 2008 through October 31, 2010 are approved. (2) Duke Kentucky’s proposed base fuel cost of 25.747 mills per kWh is approved. (3) Duke Kentucky shall transfer (roll-in) a negative 8.013 mills per kWh of fuel costs to its current base rates that were being credited to customers through its FAC. (4) The rates in the Appendix to this Order are approved effective with Duke Kentucky’s first billing cycle for July 2011. (5) Beginning with the expense month for July 2011, Duke Kentucky shall use an FAC rate based upon a base fuel cost of 25.747 mills per kWh. (6) Within 20 days of the date of this Order, Duke Kentucky shall file its revised tariff sheets with the Commission setting out the rates approved herein. |

Order Entered: 1. Duke’s Motion for a Waiver from the publication requirements of KRS 424.120 is denied. 2. A public hearing shall be held on May 23, 2011, at 1O:OO a.m., Eastern Daylight Time, in Hearing Room 1, of the Commission’s offices in Frankfort, Kentucky, to allow customers in Boone, Campbell, Grant, and Pendleton Counties an opportunity to examine the application of the Fuel Adjustment Clause of Duke Energy Kentucky for the period November 1, 2008 through October 31, 2010. Customers interested in attending this hearing shall notify the Commission in writing of their intent to attend no later than May 19, 201 1. If no notices of intent to attend are received by that date, the hearing shall be cancelled and the matter shall be considered submitted for decision based on the evidence in the record. 3. Not less than 7 days nor more than 21 days prior to the scheduled hearing, Duke shall publish in a newspaper of general circulation in each of its Kentucky service territories of Boone, Campbell, Grant, and Pendleton Counties, notice of the May 23, 201 1 hearing, including the due date for filing notice of intent to attend and that the hearing shall be cancelled if no notices of intent to attend are filed by May 19, 2011. 4. Duke shall file with the Commission, no later than May 19, 201 1, proof of publication of its notice for the hearing. 5. The official record of the proceeding shall be by video only. |

Order Entered: (1) Duke Kentucky shall appear in HR 1 of the Commission’s offices March 22, 2011 at 10:00 am EDT. (2) Not less than 7 days nor more than 21 days prior to the hearing, Duke Kentucky shall publish in a newspaper of general circulation in each area in which it serves, notice of the purpose, time, place and date of the hearing. (3) Duke Kentucky shall file no later than 3/18/11 proof of publication of its notice for the hearing. (4) The Commission adopts the procedural schedule set forth in Appendix A . (5) Duke Kentucky shall file on or before 2/14/11, its responses to all requests for information listed in Appendix B. (6) Duke Kentucky shall, on or before 2/14/11, file written direct testimony of the witnesses Duke Kentucky intends to call at the hearing. (7) At the hearing neither opening statements nor summarization of direct testimony shall be permitted. (8) Any party that files testimony in this proceeding shall file the original and ten copies of that testimony. (9) Service of any document or pleading shall be made in accordance with 807 KAR 5:001, Section 3(7), and Kentucky Civil Rule 5.02. (10) All documents shall be served upon all parties. (11) Intervenors may serve interrogatories and requests for production of documents in accordance with the procedural schedule. (12) All documents Duke Kentucky filed with PSC for the period under review are incorporated by reference. |
