Big Rivers Electric's Letter RE: Hearing Not Necessary

Order Entered: No later than ten days from the date of this Order, Big Rivers and the each of its three Member Distribution Cooperatives shall file a statement as to whether there are any material issues of fact that warrant a hearing or whether this case may be submitted for adjudication based on the existing record without a hearing.

Big Rivers Response to Staff's First Data Requests

Order Entered: (1) Big Rivers and its three Member Cooperatives listed in footnote 2 shall be made parties to this case. (2) The procedural schedule set forth in Appendix A shall be followed.(3) Big Rivers shall appear on date set forth in Appendix A. The three Member Cooperatives, or Big Rivers on their behalf, shall also submit themselves to examination. (4) Big Rivers shall, by the date in Appendix A, file its prepared direct testimony and the three Member Cooperatives, or Big Rivers on their behalf, shall file their prepared direct testimony. (5) Party filing testimony shall file an original & ten copies. (6) a. The information requested herein is due on or before the date specified in Appendix A. Responses shall be appropriately bound, tabbed and indexed & include name of witness responding. b. Each response shall be answered under oath or, be accompanied by a signed certification. c. Any party shall make timely amendment to any prior response. (7) Within 7 days of granting intervention to a party, Big Rivers shall provide party with a copy of its monthly environmental surcharge reports. (8) Big Rivers’ monthly environmental surcharge reports & supporting data for the review period shall be incorporated by reference into the record of this case. (9) The Commission does not look favorably upon motions for continuance (10) Nothing contained herein shall prevent the Commission from entering further Orders in this matter.
