PSC’s Proposed Regulations and Amendments to Regulations
The Public Service Commission (Commission) has undertaken review of its Administrative Regulations. The Commission, as it reviews its regulations, would like to involve all stakeholders at all stages in this process. The Commission believes that this review should be a joint effort of this agency and all stakeholders to develop regulations that promote and foster an effective and efficient administrative process. As part of the review process, the Commission requests that stakeholders submit written comments and suggestions on the regulations as they are reviewed.
The Commission has completed its review and made several proposed changes to 807 KAR 5:001 (Rules of Procedure), 807 KAR 5:006 (General Rules), and 807 KAR 5:011 (Tariffs). The Commission has also drafted two new proposed regulations one of which addresses pole attachments, and the other of which is a general definitions regulation. These are the first of the regulations for which the Commission will seek comments.

Once 807 KAR 5:001, 5:006, 5:011 and the proposed regulations have been reviewed, the Commission will post other regulations, grouped by type of service, for stakeholder review and input. At that time, the Commission will alert stakeholders of the deadline to file comments and when public meetings will be held. Once all regulations have completed the stakeholder process, the Commission will file the new regulations and the amended regulations with the Legislative Research Commission. The stakeholder process will not replace or circumvent the procedure for promulgating regulations provide for in KRS Chapter 13A.
