Order Entered: 1. Inter-County Energy’s motion for deviation from periodic meter testing required by 807 KAR 5:041, Section 15(3), or alternatively, sample (statistical) meter testing under 807 KAR 5:041, Section 16, is granted. 2. Inter-County Energy, pursuant to 807 KAR 5:041, Section 15(3), shall continue to test all meters removed from service. 3. Inter-County Energy shall resume periodic meter testing as required by 807 KAR 5:041, Section 15(3), or alternatively, sample (statistical) meter testing under Section 16, on or before February 1, 2027. 4. This matter is closed and shall be removed from the Commission’s docket.

Order Entered: 1. Inter-County Energy’s motion for confidential treatment for Exhibits 1 through 4 to its application is granted in part and denied in part. 2. Inter-County Energy’s motion for confidential treatment for redactions from Exhibits 2 through 4 to its application pertaining to non-selected bids is granted. 3. Inter-County Energy’s motion for confidential treatment for redactions from Exhibits 1 through 4 pertaining to Landis+Gyr bids is denied. 4. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for ten years or until further order of this Commission. 5. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001E, Section 13(9). 6. Inter-County Energy shall inform the Commission if the designated material granted confidential treatment becomes publicly available or no longer qualifies for confidential treatment. 7. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Inter-County Energy shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878.

Final Order Entered: 1. Inter-County Energy’s request for a CPCN for the proposed project described in its application is granted. 2. Inter-County Energy shall immediately notify the Commission upon knowledge of any material changes to the project, including, but not limited to, a material increase in costs and any significant delays in construction. 3. Any material deviation from the construction approved by this Order shall be undertaken only with the prior approval of the Commission. 4. Inter-County Energy shall file with the Commission documentation of the total costs of the projects, including the cost of construction and all other capitalized costs, (e.g. engineering, legal, administrative, etc.) within 60 days of the date that construction authorized under this CPCN is substantially completed. Construction costs shall be classified into appropriate plant accounts in accordance with the Uniform System of Accounts for electric utilities as prescribed by the Commission. 5. Inter-County Energy shall file a copy of the “as-built” drawings, if any, and a certified statement that the construction has been satisfactorily completed in accordance with the plans and specifications within 60 days of the substantial completion of the construction certificated herein. 6. Any documents filed in the future pursuant to ordering paragraph 2 through 5 shall reference this case number and shall be retained in the post-case correspondence file for this proceeding.
