Order Entered nunc pro tunc, that: 1. The rate schedule contained in Appendix A to the September 19, 2022 Order is stricken and replaced with the rate schedule contained in the Appendix to this Order. 2. All other provisions of the Commission’s September 19, 2022 Order that are not in conflict with the terms of this Order shall remain in effect.

Final Order Entered: 1. The findings contained in the Commission Staff’s Report, are adopted, and are incorporated by reference into this Order. 2. The water service rates proposed by Western Fleming District are denied. 3. The water service rates set forth in Appendix A to this Order are approved for services rendered by Western Fleming District on and after the date of service of this Order. 4. Within 20 days of the date of service of this Order, Western Fleming District shall file with this Commission, using the Commission’s electronic Tariff Filing System, new tariff sheets setting forth the rates and charges approved by this Order and their effective date and stating that the rates and charges were authorized by this Order. 5. Western Fleming District shall use the midpoint of the depreciable lives of the NARUC Study ranges, as recommended by Commission Staff, to depreciate water plant assets for accounting purposes in all future reporting periods. Western Fleming District shall not make adjustments to accumulated depreciation or retained earnings to account for this change in the accounting estimate.

Order Entered: 1. Western Fleming District’s amended application is accepted as filed as of May 6, 2022. 2. Western Fleming District shall not place the proposed rates into effect until the Commission issues an Order approving the rates or six months from the date the application was amended, whichever comes first. 3. Within 14 days of the date of this Order, Western Fleming District shall notify its customers of the implementation of the rates calculated in the Commission Staff’s Report by publishing notice of the increase in a newspaper of general circulation in its territory or placing an insert in bills rendered to its customers. The customer notice shall contain the information set forth in the Appendix to this Order. 4. Western Fleming District shall provide proof of publication of the notice to the Commission no later than 30 days from the date of this Order. 5. If the Commission does not receive any written requests for intervention or a hearing in this matter within 30 days of publication of new rates, this case shall stand submitted to the Commission for a decision based upon the existing record.

Order Entered: 1. Western Fleming District’s request to withdraw its Alternative Rate Filing is denied. 2. Staff shall conduct a limited field review of Western Fleming District’s financial records. 3. The procedural schedule issued on December 3, 2021, is replaced with the procedural schedule attached as an Appendix to this Order.

Western Fleming Water District requests permission to withdraw the previously submitted Alternative Rate Filing Application while continuing to pursue a temporary Water Loss Reduction Surcharge.

No later than 14 days after the date of the filing of the Commission Staff Report, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings contained in the Commission Staff Report; and b. Any additional evidence for the Commission to consider.
