Order Entered: 1. NKWD's petition for confidential protection for all paper and electronic diagrams and maps of the NKWD water distribution system submitted with its application is granted. 2. The designated material shall not be placed in the public record or made available for public inspection until further Orders of this Commission. 3. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. NKWD shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect the material granted confidential treatment by this Order NKWD shall have 20 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If NKWD is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the requested material available for inspection for 20 days following an Order finding that the material no longer qualifies for confidential treatment in order to allow NKWD to seek a remedy afforded by law. |

Final Order Entered: 1. Northern District is granted a CPCN to proceed with the proposed construction as set forth in its application. 2. Northern District shall notify the Commission prior to performing any additional construction not expressly authorized by this Order. 3. Any deviation from the construction approved by this Order shall be undertaken only with the prior approval of the Commission. 4. Northern District shall require construction to be inspected under the general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with the best practices of the construction trades involved in the project. 5. Northern District shall submit an application to the Commission prior to issuing any securities that require approval pursuant to KRS 278.300. 6. Northern District shall tile with the Commission documentation of the total costs of this project, including the cost of construction and all other capitalized costs, (e.g. engineering, legal, administrative, etc.) within 60 days of the date that construction authorized under this CPCN is substantially completed. Construction costs shall be classified into appropriate plant accounts in accordance with the Uniform System of Accounts for water utilities prescribed by the Commission. |

Order Entered: 1. All future correspondence or filings in connection with this case shall reference the above case number. 2. All documents submitted in this proceeding shall comply with the Commission’s rules of procedure as set forth in 807 KAR 5:001 and any deviation from these rules shall be submitted in writing to the Commission for consideration. 3. Any party filing a paper shall upload an electronic version using the Commission's E-Filing System and shall file an original and six copies in paper medium, except that only two copies in paper medium shall be filed of maps, plans, specifications, and drawings pursuant to 807 KAR 5:001, Section 15(2)(d). 4. Any request for confidential treatment of material submitted shall conform to the requirements in 807 KAR 5:001(13). 5. Materials submitted to the Commission which do not comply with the rules of procedure or that do not have an approved deviation are subject to rejection pursuant to 807 KAR 5:001, Section 3. |
